The “Regulation on the modification of the Regulation on real estate trade” of the Ministry of Commerce was published in the Official Gazette.

Minister Pekcan, in his written statement, gave information on the regulation change and the system to be established.

Pekcan stated that the regulations for the real estate sector were prepared taking the opinions and contributions of the relevant parties as well as the representatives of the sector, adding that “we aim to increase the quality of service in real estate activities, eliminate unfair competition and prevent informality “.

Pekcan said that their objective is for the real estate activity to develop under conditions of fair competition, in an easy, fast and safe environment, and for the sector to function healthier by making it more qualified.

2 MILLION 400 THOUSAND PROPERTIES SOLD IN THE LAST YEAR

Noting that approximately 2.4 million real estate sales were made last year and the recorded economic value of these sales was approximately TL 390 billion, Pekcan made the following assessment:

“50 percent of real estate sales in our country are made through real estate companies and there are more than 60 thousand businesses dedicated to real estate activity. However, it is estimated that this figure is an intermediary in the purchase and leasing of real estate for unregistered activities. and our goal is to create a registered real estate sector and eliminate unfair competition by closely following the sector. “

THE DOORS OF REGISTERED AND QUALITY REAL ESTATE OPEN

Pekcan indicated that the transition process given to currently active real estate businesses to obtain authorization certificates ended on August 31, 2020, and stated that they cannot carry out real estate activities without a license, and administrative sanctions will be imposed on those who do real estate without authorization.

Pekcan claimed that even if more than one real estate business operated in a workplace previously, only one of them received a certificate of authorization, noting that separate authorization certificates will be issued from now on for all companies operating in the same. Workplace.

“From now on, to open a new real estate business, it is necessary to have at least 100 hours of training in real estate marketing and at least 12 months or 6 months of real estate consulting according to graduation. In addition, real estate business owners and company officials will be required to operate with Level 5 employees and insured in the real estate business with a Level 4 professional qualification certificate. THE LIMIT OF THE SERVICE FEE WILL BE EFFECTIVELY AUDITED

Pekcan claimed that in 2018, the upper limit of the service fee was determined to be 4 percent in buy and sell intermediation and as monthly rental fee in leasing brokerage, Pekcan said, in the last 2 years real estate companies have been seen who have charged service fees above these limits in order to provide additional services to citizens and this situation is strictly allowed. stressed that it will not be.

Pekcan said: “The upper limit of the service fee, which is 4 percent in real estate purchase and sale brokerage, and the upper limit of the service fee that is applied as monthly rental fee in the lease , they will be effectively inspected and administrative penalties will be applied to real estate agents who charge service fees above these limits from our citizens and the documents will be canceled, “he said.

Minister Pekcan affirmed that in this way it will help to increase the quality of the service and avoid victimization of the consumer and that businesses that do not operate in accordance with the legislation will be purged from the sector.

“No more misleading consumer ads”

Noting that a regulation was made for the first time on advertisements for real estate, Pekcan gave the information that “companies that do not have a certificate of authorization will not be able to become members of the advertising sites.”

Pekcan stated that it will be mandatory to include the authorization certificate number on all advertisements and to use the company name or title on the authorization certificate and stated the following:

Misleading information, such as missing or incorrect property information, or incorrectly marking the location of the property on the map, will not be given to consumers in real estate advertisements. On the other hand, the Ministry will apply administrative fines to companies that fail to comply with these obligations. It will not be able to become partners of non-proprietary companies, it will effectively terminate requests and complaints about advertisements, and will transmit all necessary information about advertisements and memberships to the Ministry. There are no restrictions on our citizens’ real estate advertisements that are not within the scope of commercial activities. Thanks to the regulations, unfair competition and consumer complaints caused by unauthorized and misleading advertising are prevented, and unauthorized commercial activities will be subject to monitoring and sanction by the Ministry. “

“DIGITALIZATION IS INCREASING AND REDUCING THE BUREAUCRACY IN THE PROCESSES RELATING TO THE AUTHORIZATION DOCUMENT”

Pekcan said they made great efforts to reduce red tape in trade-related processes, as in all the regulations they have carried out so far, and that bureaucratic processes in issuing and renewing authorization certificates have been reduced.

Pekcan stated: “While both municipalities and provincial directorates have conducted two separate labor controls, as of now, the control will only be done by municipalities before the license is issued,” Pekcan said.

Noting that all transactions related to the authorization certificate will be conducted through the Real Estate Commercial Information System (TTBS), which can be accessed through the Ministry’s website, Pekcan said: “Our provincial directorates will complete the requests quickly thanks to the integrations we have provided with the existing electronic systems of all the relevant institutions. In this way, the foundations of the real estate sector will be easier, faster, more secure and transparent, “he said.

THE FRAMEWORK OF SERVICES SUBJECT TO TRADE IN REAL ESTATE IS BEING DESIGNED

Noting that the regulation has outlined the framework of the services that can be provided with the services of buying, selling and leasing real estate, Pekcan said that the most demanded topics in the sector are the addresses of property titles and cadastre, addresses of tax offices, municipalities and other institutions, and the information of these institutions.
