DİYARBAKIR – The first hearing in the case concerning the murder of the President of the Diyarbakır Bar Association, Tahir Elçi, was held at the 10th Higher Criminal Court of Diyarbakır. After the hearing, which was postponed to March 3, 2021, Tahir Elçi’s wife, Türkan Elçi, and the lawyers made a statement in front of the Diyarbakır Palace of Justice.
Türkan Elçi read the text, which he was not allowed to read in the courtroom, in front of the court. Elçi’s statement is as follows:
“DEAR JUDGES
In my petition to the Diyarbakır Attorney General dated December 25, 2015 as a whistleblower, “Tahir Elçi expressed peace under the feet of a temple in a country where a Muslim community lives mostly, the holy place ‘mosque’ and the sacred word “peace”, which is considered important to humanity, joined in their testimony. I will wait without losing hope that the officials who will work with the ethics of Tahir Elçi’s conscientious duty will one day come out and hand over the murderer into the hands of justice. ”It has been exactly five years since my request was granted.
Although the last five years have not lessened the pain of the truth of death, sadly, the reluctance of the competent authorities to find the perpetrators of the heinous murder, their indifference towards victimization for various concerns and motives, and the preference for the silence has made our hopes dim.
‘THE VICDANA OF A JUDGE IS HIS INTERNAL VOICE’
The word “conscience” is also used in my petition, which I hope that “officials who have a conscience and will work with the morality of duty will one day go out and deliver the murderer into the hands of justice.” A judge is more conscientious than everyone else, the judge, unlike everyone else, as much as everyone else, as well as flesh and blood, as well as being the distributor of justice.
The conscience of a judge is also his inner voice. The inner voice is a voice from the heart, far from any political considerations, prejudice, ideology or religious thought. Rather than law being a set of rules, we have always believed that through law, everyone can live together humanely, the strong will not crush the weak, and justice will be established as a result of their power. Humanity has constantly needed the concept of justice, which has a primary importance over most values, from its earliest times to the present. The manifestation of this superior value has been possible with the practices of legal practitioners who make decisions according to the perspective of universal law, not only from their own point of view, without objectively relying on their opinions and actions. Our request from you is the execution of this practice, sir.
‘WE ARE WAITING FOR THE SOUND OF JUSTICE IN OUR HANDS’
Someone who believes in the universal principles of human rights, who understands and internalizes the moral dimension and is free from all ideological, political or religious opinions; The voice of his last words that flow from his lips for the establishment of a peaceful and war-free life in an autumn November is still in our ears. Judge, the only voice that can oppose this voice is the lofty voice of justice. We are waiting for the voice of justice with our hands on our hearts and our ears on the rafters.

As judges who objectively represent the independence and impartiality of the judiciary with its individual and public aspects, without being influenced by their personal opinions, ideologies, religious beliefs, without considering the interests of a party, without feeling the weight of pressures such as the protection of the interests of the State due to the presence of police officers among the judges, With a just decision based on the punishment of the criminal only, without inclination to the power of any political power and without personal interest; Society’s mistrust of justice will be reduced a little bit, and people will have the opportunity to live in a fair and well-being environment, judge. Because the main purpose that underlies the reason for the existence of the law is the construction of a just order in the relationships of people with each other and with the state to which they are linked by citizenship. It is useless, magistrate, to imagine citizens with strong ties to the State and society without the efforts of the judicial authorities for justice.
‘JUSTICE MUST BE AND ALL OUR JUDGE’
You said “Justice is the basis of property”, we always wanted to believe it. Who is this property, sir? Judge, every victimization experienced on one property can be a source of unhappiness for another.
