The Constitutional Court shared the justification for its decision on the annulment of the verdict that “demonstrations cannot be held on interurban roads”, which sparked a dispute with Interior Minister Süleyman Soylu with a photo taken from his Twitter account when the workers protesting on the road were blocked by the gendarmerie.
In the tweet, which saw workers protesting on the road and gendarmes blocking the road, “Unless there is compelling reason in a democratic society, people should be able to choose where to organize the demonstration.”
The Constitutional Court, by majority vote, annulled the provision that “protest marches may not be held on interurban highways” in article 21 of the Law on Meetings and Demonstrations. In the decision that led to a dispute between the Minister of the Interior, Süleyman Soylu, and the President of the Constitutional Court, Zühtü Arslan, it was stated: “Since the restriction of the right to hold meetings and demonstrations does not respond to a mandatory social need , is not considered a restriction according to the requirements of the democratic social order.
Since it was the basis of the prohibition imposed by the Manisa Governorate regarding the protests that took place after the Soma mine disaster, the article was requested to be annulled. Notably, three of the members who voted against argued that the protesters could post their demands on social media.
