CHP MP Mahmut Tanal held a press conference in Turkey’s Grand National Assembly on the decision of the 14th Istanbul High Criminal Court on Berberoğlu, who was removed as a MP. Tanal stated that it was wrong for the Constitutional Court to send Enis Berberoğlu’s rape decision to the 14th Higher Criminal Court in Istanbul. Tanal said Berberoğlu’s verdict should be sent to the 2nd Criminal Chamber of the Istanbul Regional Court of Appeals, instead of the 14th Higher Criminal Court, which abolished the local court’s decision of “25 years in prison”.
“DISPUTE OF THE JUDICIARY”
Tanal said the following:
“The 14th High Criminal Court in Istanbul announces that it has handed down a 25-year prison sentence for Enis Berberoğlu. After serving his sentence, Berberoğlu’s lawyers appeal the case. The Court of Appeal says that “this decision is contrary”, passes a prison sentence of 5 to 10 years and takes this decision reversing the decision of the 14th Higher Criminal Court of Istanbul. This means that the decision of the 14th Strong Criminal Court is repealed and that “this decision does not exist”. The decision of the Court of Appeal is valid. The 14th High Criminal Court in Istanbul has no decision. This decision has no effect. If these judges had been in law school, they would get nothing from the Penal Code. This is the discredit of the judiciary. ”
“IF THERE IS ONE VOICE, THAT SOCIETY WILL RETURN”
Tanal told the question about the government’s work for the Turkish Medical Association to have a structure similar to the multiple bar association system, “What will TTB be called? Alternatively, it will bring ‘yellow doctors’. In the same way, the Iranian regime introduced a multiple lawyers association system. If we are a rule of law, we have to comply with the democratic principles of the rule of law. Having different thoughts in society improves society. If there is only one voice in a society, that society will regress ”.
