The Izmir Provincial Consumer Arbitration Committee decided to partially refund the tuition at the request of a tutor about the private school on the grounds that the service could not be provided as specified in the contract due to the Kovid-19 outbreak.

İ.A, whose son attends a private school in the city, submitted an application to the Provincial Committee for Consumer Arbitration with the complaint that he signed an education contract of 29 thousand lira with the school in the academic year 2019-2020 but he was unable to receive the service under the specified conditions due to the epidemic.

In its request, İ.A demanded the return of 10,242 lira, 9 kurush, education and food expenses.

The delegation, after receiving the defense of the parties, decided to partially accept the plaintiff’s request and return 4,369 liras and 62 kuruş.

“BY DECISION, THE VICTIM OF THE CONSUMER HAS BEEN ELIMINATED”

Cevdet Uçan, Head of the Izmir Section of the Consumer Protection Association (TÜKODER), told the AA correspondent that, as a result of the detailed examination of the delegation, it was determined that the training could be delivered remotely for 60 days due to the epidemic, and calculated accordingly.

Uçan noted:

“The committee determined that there was an impossibility of partial performance in terms of educational services due to the epidemic and there was a reduction of 36.71 percent in the cost, and decided to return the amount corresponding to 60 days of training service. The opinion of our Association was in this direction. “
