The Criminal Magistrate of the Peace has lifted the decision of non-prosecution, stating that “due to the existence of suspicions and sufficient evidence to carry out a trial against Canan Kaftancıoğlu, the trial and evaluation of whether he is the instigator of the crime of violation of privacy and whether he has committed other crimes or not. ” The Criminal Court of Peace decided to refer the investigation file again to the Investigating Prosecutor’s Office.

WHAT HAPPENED?

Cumhuriyet reported that the President of the Republic of Communications, Fahrettin Altun, had “landscaped a road, a chimney and a gazebo” and that “these buildings were demolished by IMM police teams” on the land rented for foundations in Kuzguncuk, located in the Bosphorus projection zone.

Following the news, the Istanbul Attorney General’s Office launched an investigation against reporter Hazal Ocak, photojournalist Vedat Arık, editor-in-chief Olcay Büyüktaş Akça and editor-in-chief İpek Özbey on charges of “attacking terrorist organizations”. Access to the news in question has been blocked.

On the other hand, an investigation was launched against the president of the CHP Üsküdar district, Suat Özçağdaş, for “violating the privacy of private life” with the accusation that the director of presidential communications, Fahrettin Altun, took photographs of the house and the adjacent land.

CHP Istanbul Provincial President Canan Kaftancıoğlu, who shared his post on his social media account after the investigation, stated that Suat Özçağdaş acted on the party’s instructions and went there to determine if there was any construction at the site in question.

Following the complaint by Altun’s lawyer, an investigation was launched against Kaftancıoğlu on charges of “praising the crime and the criminal”, “inciting to commit a crime” and “instigating the violation of the privacy of privacy”. Kaftancıoğlu was invited to testify within the scope of the investigation.
Taking Kaftancıoğlu’s statement, the prosecutor decided not to prosecute, citing that there was no evidence that Kaftancıoğlu instigated Özçağdaş to commit the crime. Altun’s attorney, Sezgin Tunç, objected to the decision not to prosecute.
