Objection to Kadir Şeker’s 12.5-year prison sentence

The incident took place in the Selçuklu Yeni Istanbul Caddesi Piri Reis Park district on the night of February 5. Kadir Şeker, who wanted to intervene in the incident claiming that he beat Ayşe Dırla, Özgür Duran’s lover, stabbed Duran to death.

Preparing for the university entrance exam to study at the Faculty of Medicine, Şeker was sentenced to life imprisonment before the hearing held yesterday at the 3rd Superior Criminal Court, where he was tried for ‘deliberate homicide’. On the grounds that the crime was committed under unjust provocation, the sentence was first reduced to 15 years and, considering Kadir Şeker’s well-being at trial, to 12.5 years.

ONE-TIME DRIVING REDUCTION IS REQUIRED TO APPLY TO THE HIGHEST LIMIT

In the court ruling, the Public Ministry, which demanded the application of the maximum reduction for unfair provocation, objected to the decision of the Konya Regional Court of Justice and renewed its request.

In the prosecutor’s request, “the alcoholic Özgür Duran cursed Kadir Şeker who came to them, the deceased continued to swear to Şeker after he left them, ‘I will find you’, and when Şeker said ‘you cannot find’, the alcoholic El late Durán hit Şeker with a punch and a kick, squeezing the throat of the defendant Şeker with both hands, declaring that Şeker had difficulty breathing… ”was shown among the reasons for the objection.

The Prosecutor’s Office also opposed the court’s decision, stating that it was illegal to determine and individualize the sentence:

* In the implementation of the provisions on unjust provocation by the Konya High Criminal Court III, the penalty should be determined in 12 years in prison from the minimum limit, while it was determined in 15 years in prison above the minimum limit, reaching to the conclusion that the sentence was determined in 15 years in prison and the illegal decision was made in the individualization of the sentence requested on behalf of the public.
