The president of the bar associations of 76 provinces, including Istanbul, Ankara and Izmir, reacted to the postponement of the general assemblies of the bar associations until December 1 with the circular of the Ministry of the Interior dated October 2, which it was said to be included in the letter from the Ministry of Health a day before the official process began, and it issued a joint statement.
According to the decision of the Supreme Electoral Council dated 02.10.2020, the 76 presidencies of the bar associations declared that if the provincial / district general hygiene boards make a decision, the general assemblies of the bar associations cannot be held:
* Article 82 of the Law on Advocacy Law No. 1136 regulates that the General Assemblies of the Illustrious Bar Association shall meet every two years within the first week of October, provided that the last number is even. The legal provision was violated first by the recommendation circular, then by the decision of the Provincial Hygiene Board and finally by the decision of the YSK.
“VIRUS IS SELECTING A MEETING”
* In the General Health Law No. 1593, the Public Health Boards do not have the authority to postpone the General Assembly. In this case, it is clearly contrary to the law to repeal a regulation dictated by law, by means of a circular or decision of the board.
* Unfortunately, it is not possible to make a legal assessment of the decision of the YSK, which annulled the general assemblies of the bar association based on the decisions of the sanitation board taken illegally, but declared that there was no damage in the holding of the congresses of political parties in the same decision and revealed that the virus chose a meeting.
“WEDDINGS, MEETINGS, CONGRESS IS NOT POSTPONED …”

FEYZİOĞLU: THERE IS A PANDEMIC TRUTH
President of the Union of Turkish Bar Associations Text Feyzioğlu’s decision was evaluated as follows;
* There is a pandemic reality. We also have an obligation to fight this pandemic reality and an obligation to succeed. This is the point. Approximately 50 thousand lawyers in Istanbul, 20 thousand in Ankara, 8 thousand in Izmir and 7 thousand in Antalya have the right and the obligation to participate.
* We are talking about large numbers that cannot be compared with other organized structures. This should have been taken into account by the Supreme Board of Elections.
İZMİR BARO: WE DON’T DEFINE THE DECISION
Furthermore, the Izmir Bar Association made the following statements regarding the decision;
* As a consequence of the interpretation of the Circular of “Recommendation” of the Ministry of the Interior dated 02.10.2020 in a way contrary to the normative hierarchy, the decision on the postponement of the General Assembly of the Izmir Bar Association to be held from 17 On October 18, it was verbally communicated to our Bar Association by the Provincial Hygiene Board.
The Covid-19 virus, which does not appear in the middle of the sect’s march, the president’s rally, the inauguration of Hagia Sophia; He did not stop visiting the general assemblies of the bar association, as he did against the party congresses and the protests against the division of the bar associations.
* It seems that the true epidemic that we are living today; It is an epidemic typical of our country that is directed towards freedoms, freedom of expression, the right to vote and to be elected, and its main motive is intolerance of democracy.
“FEYZİOĞLU’S RACE TO EXTEND SEAT TIME”
* We are aware that, with the postponement of the elections, we are trying to save time for the creation of supporting bar associations and to extend the stay of Metin Feyzioğlu, who has become the government’s puppet.
* This decision on the postponement of the general assemblies of the bar association is a decision that has no legal basis, is contrary to the normative hierarchy, has a political character, and is therefore legally void.
* As Izmir Bar Association, we inform that we will not accept any anti-democratic practices imposed and that we will hold our general assembly against all kinds of obstacles on October 17/18, which is the scheduled date, and all our members, to oppose this approach which constitutes the General Assembly of the Izmir Bar Association, which is an attack on the rights of all colleagues.
