Journalist Fatih Portakal, in his post on his social media account on April 6, 2020, said: “We are going through difficult times. Also, don’t ask for money from those who have deposits or savings! Unfortunately, I can’t say it’s not possible, ”he used the expressions.
After the exchange, a criminal complaint was filed against the Banking Regulation and Supervision Agency, Portakal. The Istanbul Prosecutor General’s Office, which launched an investigation into the criminal complaint, filed a lawsuit against Portokal, demanding a prison term of 1 to 3 years for the crime of “reputation”.
“I ASKED HIM WITH MY IDENTITY”
Fatih Portakal and his lawyers attended the first hearing of the case held today at the 46th Criminal Court of First Instance in Istanbul. Asked about his profession during the identification, Portakal said “I am retired”.
Portakal, claiming that he shared his criminal charge after President Recep Tayyip Erdoğan’s Tekalif-i Milliye decisions, used the following statements:
* President’s announcement of the Tekalif-i Milliye resolutions in the 1921s in 2020 brought to mind the following question; “I wonder if he is wondering something.” Not just a journalist, but a normal person can ask.
* Although there is a reference to Tekalif-i Milliye in my words, I did not mention any property or deposit without confiscation. I thought about the question, I said in wonder, is he wondering something? There is no such thing as forfeiture in my sentence. There is the word to ask.
* I asked with my citizen identity. I use each word selectively. I thought about each one of them while writing that sentence. The seizure in 2020 is not something that can be put on the agenda. The free market economy is there.
“I HAVE FREEDOM OF EXPRESSION”
Stating that he could not have animosity with a bank or institution, Portakal said: “If the President of the Republic is passing this sentence, as a citizen, I can ask this question. I am a journalist, a citizen. I have constitutional rights. I have freedom of expression, freedom of thought. I questioned it both as a citizen and as a journalist ”.
INSULTING THE PRESIDENT
After the defense, the court judge stated that an indictment was prepared against Fatih Portakal for “insulting the president” and that he went to court to demand consolidation.
When the judge said that the charge had not yet been accepted, Portakal’s lawyers said they wanted to examine the charge.
Upon announcing its decision after the statements received, the court decided to examine the accusation and, if accepted, forward it to the defendant and his defense lawyers and postponed the hearing.
