Reply to Süleyman Soylu from the President of the Constitutional Court

On the eighth anniversary of the acceptance of the individual complaint before the Constitutional Court, a symposium was held on “Protection of fundamental rights and freedoms in the Internet age”. When AYM President Zühtü Arslan went to Kahramanmaraş due to the death of his father-in-law, Derviş Tarakçı, Vice President Hasan Tahsin Gökcan read the speech he prepared for the opening of the symposium.

Stating that freedom of speech is often freedom of criticism, Arslan defines criticism as the hallmark of democracy, addresses himself and says: “You don’t need to get police protection. Go work on your bike, let’s see, ”Interior Minister Süleyman Soylu said as follows:

* “Court decisions, especially AYM decisions are not deeds. It can be criticized, it must also be criticized. The judicial institution whose decisions are institutionally criticized benefits the most from this.

* However, I think that at least two points are important for the criticism of court decisions to be useful. First, to criticize any text, you must first read and understand it.

* This also applies to court decisions. Criticisms made on the basis of assumptions without even justification that the decision is posted or made unread after posting results in misinformation and guidance from the public.

WITHOUT READING, UNDERSTANDING …

* We see in some criticisms of decisions that our decisions are criticized without being read and, sometimes, not properly understood. However, sound criticism requires reading and understanding what is read correctly.

* Otherwise, what was not said in the decision can be shown as said. Second, criticism can be effective and helpful to critics, it largely depends on the style used. Many times, how you say “how” gets in the way of “what” you say.

* Without a doubt, the style or style of expression is also guaranteed by freedom of expression. Of course, everyone is free to choose the style they want. However, it is clear that expressions that focus on decision-makers rather than judicial decision and go beyond criticism will not bring benefit, because they will keep criticism out of their environment.

The message from Arslan, who quoted Mevlana as saying “The language we use basically reflects our identity and personality”, “The man is hidden under his tongue” ended as follows:

* I would like to emphasize that all these statements about the expression and its style are primary and particularly valid in terms of statements made on the Internet, publications and the language used.

* As a result, AYM, the scope of the tasks that the Constitution and laws provide for him and his powers, fundamental rights and freedoms in the Republic of Turkey is trying to preserve the quality of the democratic rule of law that it ensures.

* He also strives to perform his duty to the best of his ability. On this occasion, I would like to make a public appeal from here.
