The General Assembly of the Constitutional Court ruled that Enis Berberoğlu, who was sentenced to 5 years and 10 months in prison for allegedly delivering the images of the detained MİT trucks to the Cumhuriyet newspaper, unanimously violated the right to be elected and to participate in political activities, as well as the right to liberty and security.

The General Assembly of the Constitutional Court, which processed the request at its current agenda meeting, ruled that Berberoğlu’s right to be elected, to participate in political activity, and to freedom and security were violated.

Berberoğlu was sentenced to 5 years and 10 months in prison for “divulging information that should remain confidential for the security of the state or for national or foreign political gain for the purposes of political and military espionage.”

The 16th Criminal Chamber of the Supreme Court of Appeals confirmed Berberoğlu’s prison sentence on 20 September 2018 and decided to stay the execution of his sentence and release him until his term in parliament.

Enis Berberoğlu’s final judgment, which was released by Supreme Court decision, was read in the General Assembly of the Grand National Assembly of Turkey on June 4, 2020 and Berberoğlu’s parliamentary membership was removed from the CHP. Arrested the next day, Berberoğlu was arrested again and sent to prison, and was released from prison the same day as part of the measures against the coronavirus.
