The authority of the newspapers and kiosks for the sale of products affiliated to the Istanbul Metropolitan Municipality (IMM) was granted to Istanbul Kültür ve Sanat Ürünleri Ticaret AŞ with the decision taken by the IMM Council. IMM specified that in the new contract, the rents of the newspaper kiosks in Istanbul will increase by up to 560 percent and an invoice of up to 80,000 to 300,000 will be issued as a renewal fee. It was indicated that the concessionaires that did not sign a new increase contract until September 21 will be tendered until October 1. The merchants who run the buffet stated that IMM President Ekrem İmamoğlu was misinformed and asked them not to be able to pay these fees and to stop this practice.
According to the report by Fatma Aksu and Burcu Purtul Uçar of the Hürriyet newspaper, Ferihan Karasu, director of the Istanbul Chamber of Newspaper Distributors and Tekel, said: “We have 176 kiosks in Istanbul. We are signing a contract with Kültür A.Ş., a subsidiary of IMM. The decision was approved on August 17. Following this decision, we had a meeting with the CEO of Kültür A.Ş. He told us he would change the buffets around here and expand the range of products. He admitted that we do not earn money from the newspaper and AKBIL. A week later, he called all the dealerships and gave them a draft of the contract. They said in the contract that rents would increase between 6 and 15 thousand TL. We see that the rise has increased to 560 percent ”.
Speaking about building new kiosks, Karasu stated that after the new kiosks are made, profits will be seen and new rentals can be determined this way. Ferihan Karasu said: “This is our only request. The worst thing is: I give you a week, they say, if you can’t pay, I turn off the kiosks. The distributors stayed in the middle. They call it forty lines or forty mules. They say, ‘Let go, get unemployed, stay hungry, you didn’t work for the summer, you took out loans, I couldn’t pay them, or find this money and bring it to me. They want the impossible, ”he said.
FROM 3 THOUSAND TO 15 THOUSAND TL …
Karasu said they are newspaper distributors and not distributors who sell food and beverages. “We are newsstands. We are not those merchants who sell doner food and drink. But all the photographs included in this statement that they gave to the press were doner kebab, sausage kiosks. Our rents vary between 2 thousand and 3 thousand TL. But at the moment, 15 thousand are requested from the buffet that pays 3 thousand lire ”, he said.
Karasu pointed out that the price is determined between TL 80 thousand and TL 300 thousand as a renewal fee for the buffet buildings and said: “They have determined 12-month fees for the money of the new kiosks. But they will deliver the kiosks after 12 months. How will we pay the fee for a 200 thousand TL buffet that you will deliver in 12 months and expand the range of products? How are we going to pay these high rents before moving on to these benefits? “She said.
‘OUR PROFITS ARE LOW, OUR SITUATION IS BAD’
Muhammet Köroğlu, buffet manager at Bahçelievler: “We have been operating for 13 years. Our rent was 1410 lire. They increased it to 5,000 lire. They also asked for 90 thousand TL for the buffet. We are already working with small profits. In the pandemic, things have been cut in half. Our situation is still bad. He says accept this contract or leave the key until October 1. From 60 to 65 years old it does not go out. I should have pressed AKBİL like crazy at this hour, but you see, there is no back and forth. 5 cents of cigarettes, 5 of 1000 from AKBİL. Now consider whether new rents are paid with this money. This is not a raise, an instruction to leave. “
Murat Yanbeyi, who runs a kiosk in front of the Bakırköy metro: “They have not received rent from us since January because the contract has not been renewed. Now they want them all together. On top of that, they increased the rent. My rent was 1700 TL, now they want 8 thousand TL. They want 100,000 lire for the kiosk (buffet building). They established a brand called Bufe Istanbul. For that brand, they want an operating fee of 100% of the rent as a face price each month. In total, they want me 17 thousand 733 TL every month. 90 percent of distributors cannot do this. So they say let you go They label us as proponents. How can I get that money? No toast, no burgers. We sell Akbil, cigarettes, newspapers. This is not a revenue gate, but the municipality sees it that way. There is no way of our payment. “
WE SAVE IF YOU DO NOT WIN IN COURT
Yasin Keklik, manager of a buffet in Cevizlibağ: “We have been operating this buffet for 15 years. That money is never paid in this market. The market is very quiet. The buffets were closed for 3-4 months. The debts were in a row. We take credit. Rent is now 9 thousand. It was 1830 lire. We can not pay. We gave it to the court, if we can’t win, we will leave. They want 100,000 lire for the new buffet. Nor were schools opened. Our income comes from the schools. There is a dormitory and there are no students. We are sleeping, so there is no work. I think unscrupulous. They do not wait for the disease to pass. We were delighted when İmamoğlu arrived. He went and took care of the fishermen in Eminönü now. You are the president of the IMM, go do other things. Why are you playing with the nation’s bread?
‘EVEN WE CANNOT SELL TEA’
Zafer Tekin, who runs a kiosk in Ataköy: “I have been running this kiosk since 91. Now people don’t go out because of the pandemic. We want to sell tea, it is not allowed. We say we should sell food with a certain date in sealed packages, they say no. They do this when they should help us overcome the pandemic. Take the money from the building, which did not give us its title deed. We support that everything will go well, but everything will get worse. They say it pays on October 1. I am calling our dear president, the elders have a word, be assured, but do not cut mercy. They hit the fallen with a kick. The buffets have no political connection. “
PRESENTED THE MUNICIPALITY WITH INFLATION DIFFERENCE
Following IMM’s 500 percent increase, AK Party councilors claimed the app was illegal, while IMM defended this increase as an inflation difference. In the statement made by the IMM, it was indicated that since the beginning of 2020, until the decision of the parliament, no rental fee was charged for the kiosks and said: There was also a 75 percent discount. Our kiosk businesses, renewing their contracts, will pay their rental rates in June, July, August, and September at a 25 percent discount. The determined prices were made considering the difference between the newsstand and the food kiosk. The expert staff of the Directorate of Real Estate assesses its location and characteristics according to the areas where the kiosks, pedestrian and vehicular traffic, workplaces, bazaars and parks are located ”.
NO LEGAL FOUNDATION
Muhammet Kaynar, the head of the IMM Council’s AK Party Legal Commission, stated that the rents of existing buffet operators are automatically extended each year, and that IMM cannot request a rent increase or evacuation by sending a letter He said: “If the rent is low, you can file a ‘rent increase lawsuit’ according to section 344 of the Code of Obligations. You cannot increase the rental rate by sending a letter. Especially when sending a letter to the current tenant, you cannot demand money from them, such as air money. This is prohibited and this request has no legal basis. Merchants are required up to 300,000 lire under the cost of reorganization and design. IMM gives an example of this design and you cannot make it yourself. To whom is transferred the money of the demand of 300 thousand lire for the design, which will not cost even 30 thousand lire if the operator of the buffet does it himself. Who will the difference go to? This too must be questioned. ”
