Tim Cook and other Apple Pal executives will testify against Epic at the Fortnight trial



The case concerns the outcome between the maker of one of the world’s most popular video games and Apple’s leading mobile device company in control of its App Store. Epic is suing Apple Pal on charges of breach of trust.

Apple (AAPL) CEO Tim Cook, software engineering chief Craig Federigi and Apple Pal associate Phil Schiller are some of the officials who could testify, according to the court’s interim witness testimony. Others include those who handle the payment process, face fraud and are involved with App Store development, policies and tools.

“Our senior executives are looking forward to sharing with the court the innovations that have had a positive impact on economies around the world and the consumer experience over the last 12 years. “In order to increase its revenue, it removed them from the App Store,” the statement said.

Epic Games plans to call on its founder and CEO Tim Sweeney and other senior executives to testify about things like its business model, financial performance and its campaign against app stores. Epic declined to comment.

IPhone maker and maker of the popular video game Fortnight has been embroiled in a legal battle since last year after Apple Fort removed the Fortnight game from its App Store by App Pal. It was removed after Epic pushed a software update into the app that allowed players to install Apple’s%-Payment system of Apple Pay’s payment system – which is prohibited by agreement. Google also removed Fortnight from its store.
Sweeney believes the requirement violates antitrust laws because it forces developers to use Apple Pay and Google’s payment systems. Epic then filed a lawsuit against both tech companies after the store removal, arguing that the courts would intervene and order Apple and Google to sell the app to developers without a 30% revenue reduction.

According to court documents, the Apple vs Epic Games hearing could take place as early as May 3.
