In Hochdorf, a bar operator appeared in the district court. It is said to have violated Covid 19 regulation.
“Such a high fine: it hurts!” Sarina Conti stands in front of the Braui-Zentrum in Hochdorf, which has spontaneously turned into a courtroom, and explains why she defends herself against these buses in court. The Lucerne prosecutor’s office imposed around 1,500 francs on him last April, a fine of 1,000 francs plus legal costs.
Drink consumed on the spot instead of to go
Conti is said to have violated Covid 19 regulation. According to the prosecutor’s order, the restaurant owner and owner of the Fläckebar in Lucerne’s Rothenburg on April 6, 2020, “had two guests in the open-air area of the Fläckebar drinking his glass of plastic”. Although he knew that this was not allowed according to the Corona rules in effect at the time.
Customers could have picked up their drink to go, but it was forbidden to consume it on the spot. The policemen who passed in front of the restaurant observed the scene, took photos and reported it to the prosecutor. Later, Conti flapped said bus toward the house.
A “stupid coincidence”?
She could have paid the fine and it would all have been done. But the restorer felt misunderstood and took the case to district court. On Monday morning, he explained his point of view at the hearing. By the time the police passed the Fläckebar, two people had just finished consuming their drinks in front of the bar, but it was a “stupid coincidence”.
“Due to the new Covid law, we switched to takeout and I served customers through the bar window,” says Conti. “Two people came with a mug of beer in hand and started talking to me. I instructed them not to stop. They did it anyway. ”He didn’t serve the two of them beer.
Then an older man came to the window and ordered a drink and a hot dog. “I also told him that he couldn’t wait for the hot dog in front of the bar, but that he had to go.” But the man did not understand. “At that moment the police passed by.”
“The cops could have been lenient”
Sarina Conti insists: She is not willing to pay such a high fine for this “stupid coincidence” and then get a criminal record entry. “We did everything possible to comply with the measures.”
The police could have been lenient and warned them. «It has been a hard year and then another fine. I don’t know how to pay it. “Currently, he doesn’t even earn double the expected fine per month. Conti now hopes the sentence will be lifted.
“Flawless” criminal record
The prosecutor was not present in court. Notification that they adhere to the sanction order should be sufficient. That is why the negotiation ended after about 20 minutes. During this time, the judge mainly heard Sarina Conti’s defense speech.
At the end of the hearing, the judge said he wanted to think twice about his trial. Sarina Conti could use the “impeccable” criminal record, as the judge said. The ruling will be given later in writing.
