Prosecutor pleads guilty
While the accused insists on his innocence, the prosecutor pleads guilty. She lists nine pieces of evidence that lead her to this conviction.
On the one hand, it refers to the behavior of the 57-year-old man before the fire. Since February 8, the defendants had behaved in a conspicuous and strange manner. He told several friends that Daniela was hurt. However, he sometimes claimed a head injury while walking a dog and sometimes a shoulder injury after a horse riding accident. The alleged hospital appointments never took place.
Did Robert Schmid want to hide the traces on his cell phone?
Because the deceased was not actually active on her cell phone for some time after February 8, the prosecutor assumes that she was murdered that day. According to the forensic medical report, this is possible. In the following days, the defendant is said to have used her cell phone to cover up the death. The prosecutor justifies this assumption with a text message to Daniela S’s superior: “She used to write in dialect, that was the first time in standard German.”
It is also noted that the defendant turned off his own telephone on February 8, at the time of the fire. The flight to France immediately after the fire and his silence during questioning also stressed Robert Schmid, according to the prosecutor.
Prosecutor asks for 17 years in prison
The main reason is the difficult relationship with the 41-year-old. “The accused had the opportunity, the means and the motive to commit the murder and set the fire,” said the prosecutor. “The evidence is overwhelming in its totality. The mosaic gives a coherent and almost complete overall picture. “
She demands a 17-year prison sentence for the gun fanatic. In addition, you must fully bear the procedural costs. Attorney for the victim’s family and Robert Schmid’s defense attorney will testify until Friday. The verdict will come next week.
