A mandatory vaccination? Advantages for people vaccinated with corona? In order to end the Crown crisis as soon as possible, these issues are being hotly debated in many European countries. In Switzerland too.
The National Ethics Committee (NEK) today presented its recommendations on the subject. It is clear to them that mandatory vaccinations cannot be ethically justified. This, namely, “would disproportionately interfere with essential fundamental rights.” This applies to a general mandatory vaccination, but also to an obligation only for certain groups, such as health workers.
Because at the moment only the effect of the vaccine has been proven to protect those vaccinated. “Generally, prescribing such self-protection for certain groups of people would be paternalistic and unjustifiable,” says the NEK.
Benefits for vaccinated people?
On the other hand, the Ethics Council is more open when it comes to the benefits for people who have been vaccinated against the crown. The Commission believes that under certain conditions it may be justified if a vaccination certificate is temporarily required for certain activities of daily living or if some restrictions are removed for vaccinated persons.
However, the advantages can only be justified if the vaccine also guarantees protection against the transmission of the virus and all people who want to be vaccinated have access to the vaccine, which has not yet been the case. In addition, it is imperative to ensure that “fundamental rights are preserved for all despite any unequal treatment and that it is possible for all people to meet their basic needs,” says NEK.
Advantage is not allowed everywhere
The ethics committee differentiates between different situations: A vaccination certificate may be legitimate on the plane, otherwise safety on long flights cannot be guaranteed. However, in the cinema, on public transport or at concerts, this might not be the case from NEK’s point of view: a safe environment can be created for visitors with minor restrictions such as the requirement for a mask and distance rules.
Since freedom of contract applies to individuals, they should theoretically prefer vaccinated people. However, the law leaves a lot of room for interpretation: there are currently numerous unanswered questions.
