For the St. Gallen prosecutor’s office, one thing is for sure: take-out businessman Markus Heim is guilty of racial discrimination. This is because in Rorschach, disguised in black, he sold Dubler “Mohrenköpfe”. Heim sees the verdict as a “joke” and wants to continue.

The campaign caused a sensation: Last June, St. Gallen café businessman Markus Heim, disguised as Schwarzer, sold Dubler “Mohrenköpfe” in Rorschach. The background to the campaign: Migros had recently withdrawn the dessert from its range. This is because the manufacturing company refuses to change the name of its controversial product. According to Heim, the “Mohrenköpf” in Rorschach found great sales: all 400 pieces were sold out in two hours.

Several critics liked the “Mohrenkopf” campaign less, for example, the Heks anti-racism advisory center, which they deemed “unnecessarily provocative and damaging to a part of our society.” The St. Gallen prosecutor’s office later verified the legal situation, especially since racism is an official crime. Now his verdict is available: Markus Heim has received a sanction order for racial discrimination.

This is what the prosecution argues

In his arrest warrant, the St. Gallen prosecutor wrote that in the course of the murder of African-American George Floyd on May 25, 2020, the debate over racism was rekindled in Switzerland. In this context, it was intensely debated whether the name of the candy “Mohrenkopf” was racist. After the Dubler company’s “Mohrenköpf” was removed from the assortment of large retailers for racist reasons a few days earlier, Markus Heim in his sales booth and the disguise that was supposed to show the connection between “Mohr” and “Mohrenkopf” I was attracting attention and I want to promote the Dubler product. The prosecutor also writes:

“With the aforementioned costume in combination with the product already intensively discussed in the racism debate, Markus Heim had to count on discriminating and insulting dark-skinned people when he appeared in public in his costume and selling these sweets.”

At least he accepted it, the prosecutor said. Heim has therefore been fined 30 daily rates of 30 francs each, conditionally postponed with a trial period of two years.

“He just wants to get rid of the term ‘Mohrenkopf'”

Markus Heim feels that the verdict of the St. Gallen prosecution is “pulled by the hair” and a “joke”, as he tells the “Tagblatt”. He notices:

“It’s clearly an agenda – you just want to get rid of the term ‘ear head.’

During questioning, the prosecutor wanted to know exactly what was the motivation for his action and whether he had served all the clients, Heim said. He was also asked if he knew the background to the dispute over the Dubler “Mohrenköpfe”, the death of American George Floyd during a police operation in Minneapolis. He then asked what a “Mohrenkopf” had to do with what had happened in the United States, Heim said.

“Don’t feel like bothering me anymore”

After the interrogation, Markus Heim already expected to receive a penalty order. At this point, rule out moving it to the following instance:

“I don’t feel like bothering myself anymore. The matter is as clear as day. In any case, the court would decide in the interest of the prosecutor. It’s the same club, just written differently. “

However, one thing is certain for Markus Heim: he will continue to carry out the “Mohrenkopf” sales, regardless. Another action took place in Eschlikon on Sunday, but Heim painted his face there in white:
