One incident every three hours in Europe
In several cases, this jeopardized the safety of the aircraft. From time to time, pilots had to make unplanned stopovers to leave people upset for safety reasons. In 2010, 375 cases of insubordinate behavior by passengers were reported, in 2019 there were almost 1,200, as explained by the President of the Commission, Brigitte Häberli-Koller (CVP / TG).
Or, to put it another way, for the whole of Europe: according to the European Aviation Safety Agency, incidents related to aircraft disturbances in the EU occur every three hours.
Possible claims for damages
Despite clear evidence, these unruly passengers have so far not been prosecuted. There were no jurisdictions in the states where a plane was forced to land.
Therefore, the protocol provides for a mandatory additional jurisdiction for possessing and landing states. It also contains a list of the most serious crimes. The protocol also provides for claims for damages against the person who had to be discharged for his behavior.
