The Walzenhausen Building Permit Commission, however, refused to grant the building permit and, therefore, the conversion of the property. The foundation and the canton, on the other hand, successfully appealed to the Department of Construction and Economy. The Ausserrhoder High Court upheld the appeal decision and classified the use of “sun view” as an asylum center as permissible. The Federal Supreme Court now reaches the same conclusion and therefore definitely gives the green light to the “Sonneblick” asylum center.
