The federal court has upheld the conviction of the SVP National Counselor of Valais, Jean-Luc Addor, for racial discrimination. After a shooting at a St. Gallen mosque in 2014, he wrote on Twitter and Facebook: “We ask for more!”
One person died in the shooting. Following a criminal complaint from the Central Islamic Council of Switzerland (IZRS), the prosecutor opened an investigation.
Judgment issued to Lausanne
The Sion district court sentenced Addor to a conditional fine of 60 daily fees of CHF 300 and a fine of CHF 3000. The cantonal court of Valais confirmed this ruling. Addor later transferred the decision to Lausanne.
But the Federal Supreme Court also adhered to the ruling. In today’s decision, it is stated that an unbiased average reader understands the comment as a desire to repeat the act. The reader is invited to rejoice over the tragic event at the mosque.
The Supreme Federal Court considers that the pleasure of the suffering of third parties is an expression of aversion, an essential characteristic of hatred. In this case, this joy is clearly expressed with regard to the members of a certain religion and therefore should be seen as discrimination and a call to hatred. The public is also a constituent element.
Addor: “I will not shut up”
Addor himself comments on his condemnation through social networks. He does not realize any guilt. They want to silence him, he complains, “but I will not shut up.” He is particularly concerned about being “denounced” by the IZRS of all people: two of its board members were recently convicted of spreading terrorist propaganda. He is now considering whether it is “worth the effort” to take the case to the Human Rights Court in Strasbourg, Addor said.
