They perceive scare tactics and fear mandatory vaccination: The “Friends of the Constitution” association launches the referendum against the Covid-19 law on Tuesday. The group, which claims to have more than 1,000 members, resists the Federal Council using the virus to expand its power at the expense of the people.
Among the members of the committee are recognized skeptics of the crown such as Christoph Pfluger (66), editor of the magazine “Zeit”, who has already drawn attention through controversial statements about 5G technology. Zurich cantonal councilor Urs Hans supports the referendum. The Greens kicked him out of the party in June after making conspiracy statements about the corona virus.
The emergency law is no longer necessary
Since the “health crisis” – opponents avoid using the word pandemic – has been overcome, they believe there is no reason for this unnecessary law. Because in reality it is about allowing the Federal Council to continue “governing.”
The Federal Council and Parliament see it differently: the Covid Law became necessary because many Corona measures were introduced in the emergency law, that is, through an ordinance of the Federal Council and without the approval of Parliament. To translate these measures into common law, the Covid Law was passed in the fall session, without significant resistance.
Will vaccination be mandatory? Rather not
Opponents of the law also warn against mandatory vaccination with poorly proven genetic vaccines. The background of this is that the law provides for the approval of certain drugs in an accelerated process and the obligation of vaccination for certain groups. “This would turn the population into a ‘guinea pig’,” they warn.
However, one cannot speak of a compulsory vaccination by the Covid Law: because the legal basis already exists in the Epidemic Law, which was approved by the people. This stipulates that, under certain circumstances, cantons can make vaccination mandatory for certain population groups.
The federal constitution protects physical freedom
The Minister of Health, Alain Berset (48), recently explained what it could be: a requirement could mean “that the staff of a nursing home must be vaccinated so that they can continue working with the elderly,” he said in the SRF.
But one thing is clear: neither the federal government nor the cantons can force someone to get vaccinated. Article 10 of the Federal Constitution protects the physical and mental freedom of all people. For nurses, this means: if an employee does not want the vaccine, they will have to work elsewhere, without contact with elderly or particularly vulnerable people. And it can even be terminated. (sf)
