The canton of Lucerne withdraws a doctor from Ebikon: about 350 people in an unauthorized demonstration in the city of Lucerne
The Lucerne Canton Health Department has temporarily withdrawn Ebikon’s medical license. With a solidarity action today, around 350 people attended an unauthorized demonstration in the surroundings of the old town of Lucerne.
The Lucerne health authorities have withdrawn the license to practice as a doctor in Ebikon. The doctor’s office confirmed this upon request. The doctor himself did not want to comment on this. The department responsible for health and sport of the canton of Lucerne also writes upon request that they will not comment on the ongoing procedures. The federal medical record did not reveal that the doctor had lost his license; changes to the medical record are only made when legally valid decisions have been made.
In the past, the doctor had been repeatedly critical of the measures taken by the authorities to contain the corona pandemic. He is also said to have excused some patients from wearing masks without having seen them before. He also refrained from donning a mask in his practice. A side note: in practice in Ebikon there is also a doctor who, for his part, had lost his position as a doctor in Wattwil, in eastern Switzerland, due to his stance on the coronavirus.
The withdrawal is based on the law
Ebikon’s doctor is a member of the Canton of Lucerne Medical Association. There he chairs a commission that oversees the training of medical practice assistants. Upon request, the Medical Association does not comment on the current situation.
The canton of Lucerne had already started a supervisory procedure against the doctor last September. At the time, David Dürr, head of the department of health and sports, told our newspaper: “In this specific case, there have been reviews and more will be done.”
The Federal Law of Medical Professions (MedBG) has authority for the authorization to practice the profession. There the requirements for the exercise of the profession of doctor are established. According to the law, any person who wishes to practice their profession must have the corresponding diploma, be trustworthy, offer physical and psychological guarantee for proper professional practice and have the necessary knowledge of the official language of the canton for which the permit is requested.
If these requirements are no longer met, for example if the person in question violates legal professional obligations, the cantonal supervisory authority may take disciplinary action. These can be issued in the form of warnings, fines of up to 20,000 Swiss francs, temporary or even permanent bans.
This means: if a doctor violates applicable law, such as the Epidemic Law or the corresponding Covid regulations, he must await the legally prescribed disciplinary measures. However, legal remedies are still open to the interested party. In the case of the Ebikon doctor, he would go to the cantonal court. It is not clear what the exact reasons were the canton had withdrawn the permit: the authorities do not comment on it either.
Around 350 people in an unauthorized demonstration
The canton’s actions have sparked waves of outrage in certain circles. So tonight there was a demonstration in solidarity with the doctor. The starting point was Schwanenplatz, then passed the pier on Bahnhofstrasse, past the government building, and returned to the old town. According to the Lucerne police, there were around 350 people at the scene. According to Stefan Geisseler, deputy director of urban space and events, the demonstration was not approved.

The police did not have to intervene in the rally, but they were there. The occasion was quiet. At the end there was applause for Ebikon’s doctor at Schwanenplatz. Above all, the protesters saw their freedom of expression restricted. The prohibition of arbitrariness has also been violated. Yesterday there was also a solidarity aperitif for SMEs. About thirty people have gathered in small groups at the Reuss. The police were there too.
