The appeal hearing on the homicide in Ganterschwil SG in autumn 2015 started on Monday in front of the St. Gallen cantonal court. The Court of First Instance had sentenced the FS * (35) of North Macedonia for murder to 19 years’ imprisonment. Now FS demands acquittal.

The prosecution had charged the 35-year-old in Toggenburg district court with having acted “out of the pure desire to kill”. The trigger for the act was a failed relationship with a woman he wanted to marry to stay in Switzerland.
The woman decided on the 36-year-old Slovak. The prosecutor described how the North Macedonian had an aide who was also charged take him to Ganterschwil. On a dirt road he met the woman and the Slovak. He fired nine shots at the rival and stabbed him in the chest with a knife.
The exonerating test was allegedly not carried out
A few hours later, the North Macedonian and his colleague were arrested in a brothel on Lake Constance. He did not make a confession. The prosecution relied, among other things, on the witness accounts or the results of the search for clues.
The main defendant’s lawyer had demanded the suspension of the process or acquittal. He argued that no exonerating tests had been taken.
Your colleague also wants to be acquitted
The district court sentenced the 35-year-old in March 2020 to 19 years in prison for murder and other crimes. His co-defendant colleague was sentenced to four years in prison for complicity in intentional homicide and other crimes.
The three parties appealed against the sentence of the district court: the prosecution demands 20 years in prison for the main defendant and six years for the assistant.
