“Scheissschweizer” and “Scheissmigrant”: pensioners who insult passengers and pull down their pants on the bus
On Tuesday, a man from the Principality of Liechtenstein had to answer to the regional court. He was charged with discrimination, exhibitionism and sexual harassment.
The pensioner was very drunk when the incident occurred.
The pensioner insulted a man as a “shitty Swiss” and another passenger on the bus as a “shitty migrant”. Then he pulled down his pants and “moved” his genitals for at least seven seconds.
The 60-year-old was very drunk that day in August 2020, so he said in court that he can only remember the incident very vaguely. However, the man confessed to having been discriminated against.
“I guess I should have said something like that. But only because it provoked me. “
He apologized to one of the men, who was also present in the room as a witness and private participant.
Pensioner rejects the blame
Regarding the other two accusations, however, the pensioner denied any guilt. Doing such a thing would be contrary to his character, he insisted. In addition, he would have had a prostate operation, so he would only have made a fool of himself if he had exposed his genitals, which looked like a “stump.” But then he couldn’t completely rule it out. Since two unrelated witnesses made identical statements independently of each other, the case became clear to the judge at the end of the hearing. The pensioner was found guilty.
“I don’t feel mentally ill”
The most important question to be clarified at the trial was whether the mid-1960s should be admitted to an institution for lawbreakers who need to be weaned, as required by the Prosecutor’s Office. The defendant could not understand this. “I find it very cheeky and it’s not justified,” he said. Contrary to the forensic-psychological report, which attests that he suffers from bipolar affective disorder, which has been demonstrable since 2010 and has had a severe course since 2018, the accused insisted on not feeling mentally ill.
According to the report, he has also suffered from alcohol addiction since 2019. But in the mid-1960s he also did not want to know any of that. “I have no problem with alcohol. I don’t drink hard things, just an occasional beer. ”He could only agree with the report that his sanity was severely impaired.
Would the therapy have negative consequences?
Although both the prosecution and the appraiser insisted on the admission to an institution of offenders who needed to be weaned, the defense and the trustee responsible for the pensioner spoke in favor of outpatient therapy. The latter affirmed that the hospital treatment would have more negative consequences than positive effects, since the accused would be uprooted from a network that various institutions and official bodies had been building in recent years. The administrator also emphasized that he perceived the accused as trustworthy and responsible.
Before the judge pronounced sentence, the defense, the public prosecutor and the private prosecutor presented their arguments. The latter demanded compensation of around 8,100 francs for his client, the man in front of whom the defendant pulled down his pants. Because, as the man described, the incident led to a “mental imbalance.”
The defendant had one last chance
The prosecutor demanded the guilty verdict and the briefing. The defense emphasized that the severe reduction of criminal responsibility had to be taken into account. The fact that the pensioner confesses and is ready to be treated on an outpatient basis should be considered as mitigating. The judge finally gave the defendant one last chance: the briefing and a three-month prison sentence were conditionally postponed for three years. In addition, the judge issued instructions for outpatient therapy to stop using alcohol.
