The German was driving from Bavaria / D to Geneva in April 2014 when he was photographed shortly before midnight in the municipality of Oberbuchsiten SW. The device showed 237 km / h, 110 km / h too much after deducting the tolerance margin. This stems from a federal court ruling published on Friday.
The man stayed away from trial before trial without excuse. The court eventually sentenced him to a partial prison term of 16 months for serious gross violation of traffic rules and driving without a driver’s license. The sentenced person must serve eight months.
The man appeared for the appeal hearing in Solothurn Superior Court. In addition, he maintained the version that he was not at the wheel of the 140,000-euro car that was exchanged by his company.
Others were also driving the car and someone else was behind the wheel at the time of the crime. The owner of the company did not say who it should be.
The higher court eventually concluded that the man was most likely the person who could be seen in the radar photo. In addition to conditional imprisonment, he sentenced him to a fine of 4,500 francs.
The federal court confirms the superior court’s ruling. Taking into account all the circumstances, the decision is not arbitrary. The German authorities had provided files to the Swiss judiciary as legal assistance. This shows, among other things, that the convicted person has a bad reputation in the automotive industry.
