Contact tracking data may no longer be used. Still, it happens over and over again. An example.
Like a good glass of wine with a good meal, it is now also necessary to provide contact details for a visit to a restaurant. Federal regulation Covid-19 clearly defines the rules for collecting this data for contact tracing. These are the three most important points:
- Contact details can only be recorded for the purpose of tracking contacts. The use of the data for advertising or marketing purposes is not allowed.
- Contact details must be kept for 14 days and then immediately destroyed.
- The name, the name, the place of residence, the telephone number and the seat or table number are collected.
However, not all restorers adhere to these guidelines. An “Espresso” listener told SRF consumer magazine that he checked into a restaurant using a QR code and received the corresponding confirmation by email.
So far so good. Solo – Later, the listener has another email in the inbox. It is the restaurant’s request to submit a review online. “I find it reprehensible,” says the “Espresso” listener. And the data protection advocates also clearly say: That is not possible.
Restaurant confirms errors
Silvia Böhlen, spokesperson for the Federal Data Protection Officer, says: “This data can only be collected for the purpose of tracking contacts.” The data can now continue to be used, for example for advertising. However, this requires the express consent of those affected.
The affected restaurant, the Alte Tramdepot in Bern, wrote “Espresso” in a statement that the contact tracing was changed just a few days ago and integrated into the existing reservation tool. And a bug slipped. In the case of an online reservation, the system automatically sends the email with the review request.
“Until before your request, we didn’t realize that this email now goes to all guests who sign up for contact tracking with the QR code. Now we have removed this function. In no case was it intended to continue to use contact tracing in any way or to use it for new marketing purposes. “
