He almost killed Dino Kalender (26) in February 2014 when he just wanted to go home. But Theo D. * still wasn’t punished for the mad attack. Because the German appealed to the Federal Supreme Court, successfully.
The then 25-year-old PhD student met Dino Kalender, then 19, by chance at the Milchbuck tram stop. Surveillance cameras show how the two men met at the bus stop at 3:52 a.m. They start a conversation. Everything seems normal. But when Dino Kalender walks away briefly at 4:10 a.m., Theo D. leaps up, tosses the startled man onto the tracks, and punches mercilessly. And again.
Dino Kalender suffered fatal injuries. The mad academic should go to jail for four years. Two cases have already found Theo D. guilty of attempted murder. Most recently, the Zurich High Court. But the former ETH doctoral student filed an objection, which is now approved by the Federal Supreme Court. The Zurich High Court must use the books to determine the sentence.
“I exaggerated a bit”
Lausanne judges have confirmed the conviction for attempted murder. It is assumed that there is a severe reduction in the guilty capacity of the person, but not that there is a total lack of responsibility.
The convict had criticized this point in his complaint. The massive consumption of alcohol had left him in a psychotic state. However, according to one expert opinion, he was still able to react “normally” to certain events. So he fled the police and initially stated that he “had exaggerated a bit.”
However, the convict rightly criticized the sentence. This is not understandable at all points. Therefore, the Zurich High Court must make a new decision on the originally four-year prison term.
Dino Kalender doesn’t care if his tormentor is finally punished. “He doesn’t have to go to jail for me. I just want to be found guilty, ”he told VIEW in April 2020. He only wants one thing: to lead a normal life. (jmh / SDA)
