The now 40-year-old man was sentenced in 2018 to a 12-month suspended prison term for, among other things, sexual acts with children. After an appeal by the prosecution, the Neuchâtel cantonal court also issued a five-year reprimand. The federal court upheld this verdict.
The interested party went to the ECHR and reported a violation of the right to respect for private and family life (Article 8 of the ECHR). In a ruling published on Tuesday, the court concluded that there was no violation of the Convention.
The cantonal courts and the Federal Supreme Court seriously examined the author’s personal interests. They also proceeded with the additional circumstances of this case. According to the ECHR, the Swiss judiciary had strong reasons for the referral. The Tribunal considers that the measure is proportionate. (Case 59006/18)
