The appeal was rejected in the first instance. But the residents of the Wettstein district issued the ruling. Today they gathered under the leadership of the appeals court for the inspection hearing before the entourage of the nine residents, including representatives from Swisscom, the court and others involved, came to court.

The second instance also ruled against the appeal. Eymann argued, for example, with a Basel government resolution that even kindergartens or school buildings would no longer be approved for a new antenna. Eymann: “I find the place insensitive.” But the court noted that it was a strategy document, not a legal basis. The National Council adds that it has nothing against technology.

Aesthetic reasons didn’t work

Another point highlighted by the residents was aesthetic. The antenna would spoil the urban landscape that is near a buffer zone. The court did not want to know anything about it either. “It is not an architecturally exceptional building,” and nearby listed buildings, such as Theodorskirche, are not affected.

The arguments about radiation exposure were also not convincing. Since everything has been approved and therefore legal, you have absolutely no leeway. Therefore, it is not surprising that the antenna is born. The appeals court followed the line of the construction course commission.

Swisscom declined to comment on the ruling, as it can still be challenged. However, according to the company, objections are raised in about 40 percent of antenna projects. And this significantly delays the expansion of the antennas.
