The ban on Turkish events in Reinach was legal

Shortly before implementation, it became known that several groups were calling for a counterattack. These groups came from the Antifa area and the Kurdish movement, according to a federal court ruling published on Monday.

On the day of the event planned by the Swiss Turkish Federation to commemorate the Battle of Gallipoli, there was also a soccer match between FC Basel and Grasshopper Club Zurich. This was classified as a high risk game.

Because the soccer game caught many forces, the police could not adequately protect the Turkish event in Reinach BL. Therefore, it prohibited the implementation and any other events in this area.

State protection

The Federal Supreme Court confirms the opinion of the Cantonal Court of Basel-Landschaft, according to which the Turkish commemorative act posed no danger. In principle, the implementation of such an event should be guaranteed by the state if there is the risk of associated misconduct.

However, the police correctly relied on the general police clause because the counterattacks that were known in a short time represented a danger to public security and order.

Prohibited

The ban was proportional. Contrary to the author’s opinion, it is not clear how the police could have mobilized additional forces in such a short time.

The complainant criticized that the governing council had added the motive for the soccer match. The police did not respond to this in their order.

According to the federal court, he should have briefly listed his reasons. The fact that this did not happen in the specific case is understandable due to time pressure, as the police had to react within a day.
