The leader of the SVP parliamentary group Thomas Aeschi (41) not only plays a role on the national political scene, but as a member of the SVP Baar board he also gets involved in local affairs. A dispute over the correct placement of election posters in Baar ZG resulted in spiteful mail traffic between SVP National Councilman Aeschi and SP City Councilor Zari Dzaferi (34) last year, which was finally read by more than 40 recipients. Dzaferi referred to Aeschi’s various complaints to the community. This stabbed the SVP man so badly in the nose that he filed a criminal complaint for violation of official secrecy (BLICK reported).
The Zug prosecutor’s decision on April 21 is now available. This is steep for Dzaferi. Prosecutor Martina Weber stopped the criminal investigation, but ordered the SP politician to pay a total of 1,220 francs, because “he had started the criminal process illegally and guilty.”
Dzaferi thought that everyone already knew everything
But one thing at a time: Dzaferi’s lawyer had argued in favor of his client that the events mentioned in the email were not secret because of the elections and that the recipients were “well informed, networked and frankly family-friendly.” Aeschi is only trying to use the criminal justice system for his political campaign against Dzaferi, the lawyer said.
Dzaferi himself emphasized in his interview that he had assumed that everyone already knew about the complaints. That was “completely clear” to him. So he did not worry and never felt bad.
But that was not the case: Prosecutor Weber heard four email recipients as witnesses. All of them stated that “they were unaware of what Thomas Aeschi had complained to the Baar community.”
Prosecutor: “at least contrary to duty”
In his comments, Weber gets tough on Dzaferi: He only listened to Aeschi’s complaints due to his official role as councilman. Dzaferi has revealed to several people “a secret worth protecting”.
“However, at least it would be expected that a democratically elected local council would not pass on the knowledge it has acquired in its official role to third parties without hesitation,” Weber rejects the SP man. He had behaved “at least contrary to duty”.
However, she stops the criminal investigation. Because: Dzaferi acted negligently, but not deliberately, according to his conclusion. The decision is not yet final: within the ten-day appeal period, both Aeschi and Dzaferi can challenge the prosecutor’s decision.
Thomas Aeschi is happy
Dzaferi, who took the sole seat of the SVP in the 2018 municipal council elections and has been repeatedly attacked by the right-wing party since then, did not want to speak directly to BLICK about the decision. It is a continuous procedure. In the conversation, however, he notes that he would rather deal with “real political problems” than deal with lawyers. Therefore, Dzaferi should pay the costs.
“I am satisfied with the prosecutor’s decision,” says SVP man Aeschi. “Mr. Dzaferi’s misconduct is made clear by the explanations. I hope that the Baar city council will punish the prosecutor for violating the Baar community personnel regulations. ”
