SINGAPORE – A man who used a spy pen to film friends showering in a toilet was jailed for 11 weeks on Tuesday (November 10).
The 28-year-old man’s offenses were discovered by a friend who became uncomfortable after seeing the offender emerge from the unisex bathroom with a bag.
Although the friend did not see anything suspicious, he later found the pen in the toothbrush holder and tried to use it but found that he could not write. He discovered the true nature of the pen after dismantling it.
Using two spy pens that he bought online for around $ 20 to $ 30 each, the man entered the bathroom before his victims to angle the devices toward the shower area. She would leave the devices in recording mode, targeting friends and a tenant staying at her house. After recording the victims, the man would retrieve the spy pens and watch the videos.
He admitted to taking the videos for fun, even though he knew it was wrong.
One of the victims was the girlfriend of the man who found the spy pen, while another was a close friend of the accused for seven years.
The man pleaded guilty to two counts of insulting the two women’s modesty in 2017 and one count of possessing 14 obscene movies on his phone and an external hard drive.
Three other charges involving two other female victims were taken into consideration for sentencing.
Not all victims can be named due to a gag order that protects their identities.
The man’s close friend, 26, used to visit his home. On one occasion in July 2017, he came to her home for a co-curricular activity meeting. Unbeknownst to her, the man placed a spy camera in her bathroom to take videos of her friends. He captured the victim showering on video, which lasted eight minutes.
Friend’s Girlfriend Filmed
On the afternoon of September 2, 2017, the man, his friend, and some friends visited a mutual friend who stayed in a condo to swim. After swimming, around 6 p.m., the group headed to the condo unit to shower.
It was agreed that women would use the front bathroom while men would use the back bathroom. The man decided to take this opportunity to install his spy pen in the front bathroom to film the women showering.
While in the unit, the man’s friend saw the man coming out of the bathroom and asked why he was there. However, the man did not reply.
The friend was uncomfortable when he saw the man carrying a black shoulder bag after exiting the bathroom. The friend decided to check the bathroom. Although he didn’t see anything suspicious, he found a pen in the brush holder.
The man disassembled the pen and discovered that it had a camera and an SD card. He kept the pen.
The next morning, he told his 26-year-old girlfriend about the pen and they both went through the SD card and discovered its contents. The pen contained a nine-minute video that captured the bride completely naked while showering.
The friend and the victims confronted the man on September 11, but he denied the crime and lied about it. After finding more spy devices at the man’s residence, the group decided to file a police report.
The man’s electronic devices were seized the next day and 14 obscene videos were discovered through a forensic examination.
In sentencing the man, District Judge Adam Nakhoda agreed with the prosecution that there were serious aggravating factors in this case, including a “high degree of planning and premeditation”.
“The defendant had acquired spy cameras and had a well thought out modus operandi that involved him placing the spy cameras in the toilet and directing them toward the shower area,” the judge said.
There was an element of breach of trust as the man knew the victims and the crime had occurred while the offender and the victims were meeting. There was also a “very high level” of intrusion as the victims were captured completely naked and with their faces exposed.
“There is potential for dissemination and if the videos had been distributed, they would have been even more devastating,” noted DJ Nakhoda. The judge considered mitigating factors, such as the man’s cooperation with the police, his guilty plea and that he was unlikely to repeat offenders.
The judge also included a small discount on Lee’s sentence since his case was delayed.
For insulting a woman’s modesty, Lee could have been jailed for up to a year, fined, or both.
For owning an obscene film, he could have been jailed for up to six months and / or fined up to $ 20,000.
