Five men jailed for attack on Clarke Quay that left a man dead

SINGAPORE – After kicking the back of the last car in a three-car convoy, a passenger in the car struck a man and died in the encounter after falling to the ground.

The man who delivered the coup, 28-year-old Fino Foo Zhi Peng, was jailed for two years and five months and ordered to be struck three times with a cane on Monday (November 16).

The 2017 altercation between Fino Foo and Jeffrey Tan Junjie, who died of a head injury three days later, sparked a fight between the occupants of the three cars and Tan’s acquaintances in a multi-story Clarke Quay parking lot, which which resulted in the strike of two of Tan’s acquaintances viciously with a metal rod.

Four other co-defendants, Allan Ng Wei Wen, 34, Chew Wen Cai, 33, Terence Tan Chun Hon, 31, and Lye Wing Wai, 41, were also sentenced to prison on Monday, and District Judge Christopher Goh handed the sentences to a courtroom packed with more than 40 of the defendants’ family and friends.

Other sentences passed

Ng, who wielded a metal rod, was imprisoned for two years and five months and received six strokes of the cane. Chew was imprisoned for one year, eight months and three strokes of the baton, while Lye and Terence Tan were each imprisoned for one year and three months.

The sentences of Fino Foo, Ng and Chew also included crimes unrelated to the Clarke Quay incident. Fino Foo committed a fight, while Ng faced crimes under the Remote Gaming Act for which he was also fined $ 41,500. Separately, Chew was also sentenced for hitting his girlfriend and a construction worker who had used his forklift to move Chew’s car, which was blocking the entrance to his workplace.

Two others, Phang Jun Wei and Foo Yao Zhong, were previously dealt with. Phang received an eight-week jail term for participating in an illegal gathering, while Foo Yao Zhong received a one-year and three-month prison term for rioting.

All of the defendants had pleaded guilty to their charges.

The incident

The court previously heard that at around 4.13 a.m. on April 16, 2017, the victims, Lim Soon Leng and Xie Hui, and their three friends were on level 2A of the parking lot, with Jeffrey Tan walking some distance behind them.

Six of the defendants, all men, had previously been to a Clarke Quay club and were in a three-car convoy in the parking lot at the same time as the victims.

As the last car in the convoy passed him, Jeffrey Tan kicked the rear of the car, causing the car’s occupants, including Fino Foo and Phang, to alight.

Fino Foo and Phang then rushed over to Jeffrey Tan and punched him in the face, causing the 31-year-old to fall to the ground.

The commotion led the other co-defendants to get out of the two remaining cars. Ng, who was in one of the cars, came out with a metal bar. When Lim tried to get close to Jeffrey Tan, Ng hit him in the face with the metal bar and made him bleed. Then Lim was taken away by his friend.

At this point, Xie came to Lim’s aid and said to Ng, “That’s my friend.” He was also hit by Ng with the metal rod. Six other co-defendants, including one who rushed up from the lower floors of the parking lot, attacked Xie.

The attack did not slow down even when Xie fell to the ground. He was repeatedly kicked and hit with the metal rod, which dented the metal bezel of his Rolex watch and broke the chrome bracelet. During Monday’s hearing, the prosecution requested compensation for this watch, which cost $ 2,047. However, the lawyers for the five defendants opposed the request and most pointed out that it was Ng who caused the damage with the metal bar.

Ng’s attorney, Ramesh Tiwary, told the court that his client had already offset Lim’s medical bills and that a receipt showing the value of the Rolex watch was out of date.

The fight only ended after someone yelled “let’s go” and the defendants left the scene. They left in their vehicles before the police arrived.

The incident was captured on CCTV and a passerby also recorded two videos of the incident using his mobile phone. The images of the altercation were reproduced in court.

Jeffrey Tan was transferred unconscious to Singapore General Hospital, where he underwent emergency surgery. He eventually succumbed to his injuries and was pronounced dead three days later.

The cause of death was a head injury suffered when the back of the head struck a hard surface.

Lim and Xie sought treatment at the same hospital. Lim suffered an injury to his left eye, a laceration to his left eyebrow and two fractures to his nose, while Xie accumulated blood under his scalp, abrasions, bruises and tenderness in his spine and extremities. An MRI revealed more back injuries.
