SINGAPORE – After fleeing her home, a woman sought refuge in her friend’s family’s high school apartment.
However, instead of security, the woman, who has a mild intellectual disability, only found cruelty at the hands of that family, who used pliers to twist her toes, a hammer to hit her teeth and urinated on her food, among other tortures.
One of the perpetrators, the husband of a relative, was ordered to slap the woman after she performed some sexual acts with her husband.
The man, Egyptian Hany Aboubakr Abdelkarim Abdelfattah, was sentenced to three weeks in jail on Tuesday (November 3) after pleading guilty to one of two counts of willfully causing harm to the 30-year-old woman.
The victim were friends from high school with a relative.
The victim knew the family through Muhammad Isafi Ismail, his friend from high school since 2008.
He resided with his family, including his older sister Haslinda Ismail, 34, to whom Hany is married; his mother Hasmah Sulong; his older brother, Muhammad Iswan Ismail; another older sister, Hasniza Ismail; and his brothers Muhammad Iskandar Ismail and Muhammad Iski Ismail.
The victim, who studied to his N levels, often visited Isafi and his family members in their apartment in his spare time and was close to them. She often ran away from home and stayed with the family since mid-2011.
At the beginning of 2016, the victim permanently ran away from home and moved into the family unit. He didn’t pay the rent, but he bought his own food, paid Hasmah $ 150 a month for his dirty laundry, and slept on a rug in the living room of the family’s apartment.
In December 2015, Hany got a job as a sales assistant at Giant Supermarket in Woodlands Mart. The victim worked at the McDonald’s in the mall and knew Hany almost every day as they hung out in the same area.
In 2016, the victim performed some sexual acts with Hany on a stair landing in the Woodlands Mart parking lot. Haslinda learned of the events and confronted the victim in the apartment’s kitchen a few days later. Several members of her family, including Hany, were present at the time.
During the confrontation, Haslinda scolded the victim and slapped him. Following Haslinda’s instructions, Hany pointed her middle finger at the victim and slapped her twice.
After the incident, Haslinda, Hasniza and Hasmah began abusing the victim, using pliers to twist his toes, a hammer to break his teeth, a baseball bat to hit his head, and splashing boiling water on him.
As Hasmah feared that the victim might flee or seek help from an immigration officer, he ultimately decided not to bring her to Malaysia anymore.
Hari Raya Haji Torture
On the afternoon of August 31, 2017, the eve of Hari Raya Haji, Haslinda took the victim to her new apartment, to which she had previously moved, to help her with the preparations for the family’s Hari Raya Haji.
He had the victim stand in the kitchen overnight until 11 a.m. the next day, and ensured that the victim did not sleep or use the bathroom.
On September 1, unable to control her bladder, the victim urinated on the kitchen floor. The furious Haslinda hit the victim’s body with a broom until it broke.
Haslinda then used a perch and a wet towel to assault the victim, before tying his limbs with a bridle. He made the victim stand in the kitchen in dirty pants. Hany was present but did not intervene in the matter.
Even when the other family members arrived for the Hari Raya celebrations later that day at around 3 pm, the victim remained standing in the kitchen. The other members, including Hasmah, Hasniza, and Iski, watched but did nothing to help the victim.
Later, Haslinda demanded that Hany slap the victim twice and Hany did. Haslinda released the victim from the cable ties after the rest of the family left the apartment that night. He then took the victim back to the original apartment that night.
Taken to hospital in ‘near death state’
The victim remained on this floor until she was taken to the hospital in a “near death condition” on January 16, 2018, according to the prosecution. No details were given of his condition, however his injuries resulted in a visual impairment that was noted when the victim underwent an IQ assessment on June 20, 2018.
In this evaluation, the victim was unable to perform tests to assess his general intellectual functioning due to his deficiency and the variation in his performance.
The victim was examined at the Institute of Mental Health in March this year, when it was assessed that she had a mild intellectual disability from childhood and during the time of the abuse.
The report pointed out that the victim’s deficiencies in intellectual functions such as reasoning, problem solving, planning, judgment and learning from experience would have affected his ability to seek adequate help at the time of the alleged crimes against him.
Hany’s attorney, Audrey Koo, stated that her client was “really sorry and fully cooperated with the police during the investigations.” Koo said that the victim’s disability would not have applied to his client’s actions, as the disability would not influence the slapping.
He added that his client had to care for two children, one of whom has a learning disability.
The cases against Iskandar, Hasniza and Haslinda were postponed Tuesday due to factual disclosure problems. Hasmah and Iski’s cases are still pending.
