The Attorney General’s Office (AGC) requests authorization to be heard at the application hearing for alleged misconduct by two legal service officials.
The AGC has also requested to present court notes related to the case involving domestic servant Parti Liyani and to present to the Chief Justice extracts of relevant evidence that Ms. Parti, who was acquitted of theft, and other witnesses gave.
The former maid of prominent businessman Liew Mun Leong, 46, is seeking the court’s permission for an investigation into the conduct of Deputy Prosecutors Tan Wee Hao and Tan Yanying.
The two tried her case in state courts for robbery, for which she was convicted last year.
Ms. Parti’s initial subpoena request was processed ex parte, which means that only the applicant can be heard, unless the court indicates otherwise.
The AGC seeks to be represented at the application hearing and has also requested to place excerpts from the proceeding record in the state court trial, as well as evidence notes relating to it and the witnesses, Mr. Liew and his wife, Ms. Ng Lai Peng. .
The court notes also include relevant excerpts from last year’s November 1 appeal hearing by Ms. Parti before Judge Chan Seng Onn.
Other documents the AGC is trying to put up include the prosecution’s final submissions at the trial, as well as a copy of its appeal petition, according to court documents seen by The Straits Times.
In August, in the same summons, the AGC had also requested the authorization of the Chief Justice for the two prosecutors to appear and be heard by their lawyer at the hearing on Ms. Parti’s application.
Senior State Counsel Kristy Tan and Jeyendran Jeyapal, as well as State Counsel Jocelyn Teo, were appointed to represent the couple at the hearing, if approved.
The reasons for the request were set out in the attached joint affidavit of support from Mr. Tan and Ms. Tan.
Ms. Parti, who was acquitted on appeal to the High Court earlier this month, had filed a complaint in June against the two legal service officers.
In July, lawyer Anil Balchandani was appointed to act on their behalf in connection with the complaint.
He then submitted an amended version for the Chief Justice to grant permission for an investigation into the allegation of misconduct against Mr. Tan and / or Ms. Tan.
The summons also requested that the court give other instructions it deems appropriate.
Both Ms. Parti’s initial subpoena and the request to be heard at the ex parte subpoena hearing were made before Judge Chan issued his appeal decision earlier this month.
A pre-trial conference was held on Wednesday and a new case management hearing will take place in due course.
