Death on Chin Swee Road: AGC to proceed with murder charge against the father of a 2-year-old boy whose remains were found in a flat

SINGAPORE: The Attorney General’s Office (AGC) will proceed with the murder charge against the father of a two-year-old girl whose remains were found in a flat on Chin Swee Road in 2019, it said on Friday (February 5).

In a press release, the AGC also said it had requested an “exoneration that does not amount to an acquittal” of the murder charge against the deceased’s mother.

The girl was killed in March 2014, but her remains were found on September 10, 2019 in an apartment in Block 52 of Chin Swee Road.

The little girl’s parents were charged with her murder a week later, on September 17. The father was 31 years old, while the mother was 30. They cannot be named due to a gag order.

The couple have been in custody since June 2018 for unrelated crimes.

Confirming that it would proceed with the murder charge against the father, the AGC said Friday that it also faces 13 other criminal charges, including repeated drug use, riot and failure to return to an approved institution.

“These charges will be dropped pending resolution of the murder charge,” the AGC said.

A charge that is withdrawn is temporarily put on hold, but the prosecution can re-examine it at a later stage. You can then request that the charge be proceeded with, take it into consideration for sentencing or withdraw it.

If found guilty of murder with common intent, the man could be sentenced to death or life in prison with flogging.

The AGC also said Friday that it had requested an exoneration that did not amount to an acquittal of the murder charge against the girl’s mother, “after reviewing the facts and evidence in the case.”

“His defense attorney opposed the request and, instead, requested an exoneration that would amount to an acquittal,”said the AGC.

The matter has been postponed until March 2, and the defense attorney indicated that, in the meantime, he will take steps on this issue, the AGC added.

A discharge that does not amount to an acquittal means that a person may still be prosecuted for the same crime in the future.

The mother faces 12 charges, including intentional neglect to provide medical assistance to the deceased, abusing three of her children for a period of between nine months and a year and perverting the course of justice by disposing and concealing the body of the deceased.

She is also accused of providing false information to public servants about the deceased and intentionally neglecting four of her children by leaving them without adult supervision, adequate food or water over the course of two days.

If convicted of the above offenses, she can be jailed and fined, with the most serious offense holding her liable for up to seven years in prison and a fine of S $ 20,000.

The AGC reminded the public and the media on Friday of the gag order, which restricts the publication of the name, address, photograph, evidence or anything else that may lead to the identification of the deceased or the accused.

Anyone found guilty of violating a gag order can be jailed for up to 12 months.

“The public and the media are also advised to refrain from speculating or making public comments on matters that may be sub judice, pending final determination by the courts,” the AGC said.
