A 30-year-old man pleaded guilty yesterday to one charge of sexual abuse.

The man cannot be named due to a gag order to protect the identity of the victim.

On November 15 of last year, the 25-year-old victim and the man were having drinks with a group of friends in a bar.

At approximately 1 a.m., the man, the victim, and two other friends decided to leave the bar. Since all the surrounding stores were closed, the victim suggested that they go to his house to hang out.

The four continued drinking in their living room. Both the man and the victim continued chatting after one of their friends left at 3 a.m., while the other fell asleep on the couch.

Deputy Prosecutor Daniel Ling said: “The defendant and the victim discussed ‘spooning’, which is a sexual issue. After a while, both the victim and the defendant fell asleep on the floor of the courtroom.

The victim woke up to the man hugging her from behind.

She later went to her room and fell asleep on her bed, leaving her bedroom door open.

When the man woke up to use the bathroom, he saw the victim sleeping on the bed and asked if he, too, could lie in bed.

She did not respond, but the man lay down next to the victim, who was lying on his right shoulder with his back to the man.

She woke up surprised to find the man lying next to her and did not move.

The man then touched the victim and continued to do so for a minute or two, during which time the victim did not move away or make a sound.

The court heard that the man did so because he was “tempted.”

After removing his hand, the scared and frightened victim took the opportunity to get away from him.

DPP Ling said: “Soon after, the defendant’s alarm went off, indicating that it was around 6:30 am. The defendant got out of the victim’s bed and left the (unit).”

The victim confided in two friends what happened and made a police report a week after the incident.

The man is expected to return to court for sentencing on December 23.
