REUTERS: The Nevada Supreme Court rejected an appeal late Tuesday (December 8) of President Donald Trump’s campaign to overturn the election results in the state, claiming President-elect Joe Biden’s victory in one of the battle states that gave him overall victory.
It was the latest court ruling by Trump and his allies, who have lost dozens of cases in state and federal courts in a failed attempt to overturn the November 3 election result. Trump says the result was fraudulent, but no court has found evidence to support his claims.
Last week, a district court in Nevada ruled that the Trump campaign had failed to prove a claim that voting devices had malfunctioned and that the Trump-Biden race had been rigged.
“We are also not convinced that the district court erred in applying the burden of proof through clear and convincing evidence, as supported by the cases cited in the district court order,” the Nevada Supreme Court said in your sentence.
The Nevada Republican Party said it was “extremely disappointed” by the decision.
“We were not given the opportunity to write our brief or argue the case in front of the Court,” the Nevada Republican Party said in a statement. “The total denial of legitimate due process and appeal rights is truly unprecedented, shocking and extraordinary.”
Biden won Nevada by a margin of 33,596 votes, earning him all six of the state’s votes in the Electoral College that elects the president. Voters are scheduled to meet Dec. 14 to formalize the result, with Biden winning 306 votes to 232 for Trump.
Tuesday was marked as the so-called safe harbor deadline for states to resolve disputes arising from the elections. Under US law, Congress will consider the outcome of a state election “conclusive” if it is finalized on the safe harbor date.
