SINGAPORE – The president of one of Singapore’s largest recreational clubs, about to be returned unopposed for another term after two candidates were disqualified, will have to face a challenger for the job following a High Court order last week. pass.

Senior Judge Andrew Ang issued an interim order holding that the Singapore Swimming Club management committee’s decision to disqualify Mr. S. Radakrishnan’s nomination as president will not take effect, in any event, until the court decides about the case you filed.

The court also ruled that the decision of the club’s management committee on September 11 to declare that Mr. Yeo Chui Hee is the only candidate for the office of president and that he is returned unopposed will not take effect, if at all. Until the court decides. in claims.

The club was also ordered to post a copy of their order on its notice boards and on its website.

The club’s general elections will be held on Sunday (September 27), and Mr. Radakrishnan, former club president, is leading a team to run for various positions against the incumbent’s team.

The club, through its lawyer Chang Man Phing, said that Radakrishnan will be allowed to stand for election.

He added that the court has not determined whether he should be disqualified and the matter will only be decided by the court at a hearing, which has yet to be resolved.

“This means that in the event that Mr. Rada is elected president and if the court decides in favor of the club, Mr. Rada will have to resign.”

“The club denies all the assertions made by Rada in his ex parte application, which means that the club did not have the opportunity to present its version of events in court when the court made its decision,” he said.

The club declined to comment further as the matter is still pending in court.

In court documents supporting his case, Radakrishnan’s attorney, lead attorney N. Sreenivasan, said that when the nomination papers were submitted on September 9 for the position, he was accepted by the scrutineer and was not disqualified based on club bylaws. .

He argued that on September 11, six members of the management committee had unfairly disqualified Radakrishnan’s nomination as a candidate for the office of president by relying on a separate rule for their decision.

Two candidates were disqualified from running for president, but the other disqualified member did not take the case to court.

The hearing was held in the chambers, where the plaintiff argued before Judge Ang that the disqualification meant that he would have lost the opportunity to run for the presidency and the members would also have lost the opportunity for an election for office.
