“What is the reason why the Commission insists on the abolition of the Criminal Crimes Investigation Section?” Is one of the questions that the former president of Romania, Traian Basescu, addressed to the European Commission.

Another question, asked by the Romanian MEP, according to the portal of the European Parliament: “What are the alternatives proposed by the Commission to ensure the independence of judges from pressure from prosecutors?”

Traian Basescu also makes a preamble, before addressing these questions and states that the existence of the Special Section would guarantee that the ADN cannot use cases against judges.

“The Criminal Investigation Section in Justice (SIIJ) in Romania, established within the Prosecutor’s Office of the High Court of Cassation and Justice and operational since October 23, 2017, has the exclusive competence to investigate crimes committed by judges and prosecutors The rule of law in Romania (SWD (2020) 0322), the continuation of the activity of the section may affect the independence of the judiciary, and the Venice Commission suggested its abolition.

In reality, the existence of this special section ensures that anti-corruption prosecutors cannot use cases against judges to pressure them and obtain favorable results in other cases in which they are working.

During a hearing of the US Helsinki Committee in 2017, it was revealed that judges who do not rule in favor of the National Anti-Corruption Directorate (ADN) have become targets themselves, while those deemed friendly to the interests of the DNA for their loyalty was rewarded, explaining how DNA maintained extraordinary 92% conviction rates, “said Traian Basescu.

The procedure requested by Traian Basescu is the “question with written answer”, provided toArticle 138 of the Rules of Procedure of the European Parliament: “Any member, political group or committee may address questions to the President of the European Council, the Council, the Commission or the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy in accordance with the criteria established in an annex to the Responsibility for the content of the questions rests entirely with their authors “.

The Basescu family and DNA

Several members of Traian Basescu’s family were tried / convicted in DNA cases. his brother, Mircea Basescu, was definitively sentenced in 2016 to four years in prison with execution. The ex-president’s nephew, Dragos Basescu, was definitively sentenced, in 2018, to three years in prison for influence peddling.

Traian Basescu’s eldest daughter, Ioana Basescu, is being sued by DNA, along with former Development Minister Elena Udrea, in a case aimed at financing Traian Basescu’s 2009 election campaign.
