According to the court’s decision, the doctor received 4 years in prison for three crimes of bribery, finally serving 6 years and 8 months in prison, after the sentences were merged and an increase in the penalty was added.
After leaving prison, Adrian Gabriel Ilie will not be able to exercise some civil rights for a period of 4 years, including the right to hold the position of doctor.
In the same case, a woman who bribed the doctor, Silvia Florentina Baranovschi, was sentenced to three years in prison with execution.
On the other hand, the judges confiscated several amounts received by the doctor as a bribe, but also money found by the investigators at his home: 33,260 euros, 510 dollars, 52,500 lei, 2,000 florins and 90 dinars.
Likewise, the court ordered the extension of the seizure of sums of money that the doctor and his family could not justify by income, respectively 185,737 lei, 11,382 euros and 7,140 dollars. To recover these sums, the seizure of the houses and land owned by the surgeon and his wife was maintained.
The decision is not final and can be appealed.
The trial lasted four years
The trial in this case lasted four years, and DNA sent the file to court in September 2016.
Adrian Gabriel Ilie (active military officer, with the rank of Lieutenant Colonel), at the time of the events, a primary ENT doctor at the Central University Hospital for Military Emergencies “ Dr. Carol Davila ” in Bucharest, is accused that, among On April 5 and June 29, 2016, he demanded 1,500 euros from three people and received 1,000 euros from two of them, including Florentina Baranovschi, in connection with surgeries performed on them.
DNA states that in two of the three operations it was surgery to beautify the nose (rhinoplasty).
Following a search of the laptop’s computer and the storage media collected from the doctor’s house, the investigators identified a file, in pdf format, called the “Spaghetti Manual,” which featured cases documented by journalists on how, fees, and the bribery circuit in the Romanian public health system.
Also, the prosecutors identified a file with the name “Dr. Adrian Ilie ENT Surgery Fees.xlsx”, which detailed the type of surgery, the type of anesthesia and the rate of each surgery.
“Comparing the fees charged by the Central University Hospital for Military Emergencies’ Dr. Carol Davila ‘with the fees mentioned in the file’ Dr. Adrian Ilie.xlsx ENT Surgery Fees’ it is found that the latter are much higher. (…) Also, it is observed that the fees charged by the Military Hospital are mentioned in lei, while the fees mentioned in the file identified during the computerized registration are expressed only in euros. Considering that the accused Ilie Adrian Gabriel has not practiced in other hospitals, state or private, the only logical justification for the existence of such a file in his possession is that the aforementioned fees are the fees that he demanded from the patients as bribes “, It is clear from the accusation sent by DNA in court.
It is also clear from the accusation that the doctor resorted to protective measures to avoid being caught, when he carried with him the sums of money he received as a bribe from the patients.
Thus, when they tried to catch him in flagrante delicto in his office, the investigators did not find him 500 euros, which he had just received from a patient.
Most likely, the defendant gave the amount of 500 euros to another person, not yet identified so far, so that, in the event of a complaint from the patient, the money would not be found. From this it follows that the accused, committing the crimes for which he is being investigated, senses that he could be caught red-handed with the money he receives from patients and, to deny the truth, the accused resorts to certain measures of protection consisting of hiding the money received as a bribe for the medical activity carried out within the Central University Hospital of Military Emergencies Dr. Carol Dávila“prosecutors said in the indictment.
However, the meeting between the doctor and the patient was recorded on audio-video, so there are images that show that the doctor received the 500 euros.
