The Plenary adopted this Wednesday the modifications made to GEO 123/2020 by the senators of the two commissions, so that paragraphs (4) and (5) of article 3 of GEO 123/2020 establish that “by 2021, the increase provided for in paragraph 3 will apply as of January 2022. As of January 2022, the amount of the State’s child allowance will be indexed annually, ex officio, at the annual average rate of inflation. “
In the form of the Government, paragraphs 4) and 5) of Article 3 stipulate that “between January 1, 2021 and July 1, 2022, the increase provided for in paragraph 3 shall apply twice a year, starting respectively for the rights related to the month of January and the rights related to July of each year. On August 19, the Honorable Chamber of Deputies rejected, as a decision-making body, Ordinance 123/2020, which modifies and completes article 3 of Law 61/1993 on state subsidy for children. Later, the Government challenged this normative act in the CCR, but the Court rejected the referral.
On November 13, President Klaus Iohannis asked Parliament to reconsider the law rejecting the ordinance. In the request for re-examination, the president points out that, through this ordinance, the Government established a gradual application of the increase in allowances imposed by Parliament by Law 14/2020 approving GEO 9/2019, identifying the necessary resources to grant a increase as of August 1, 2020. of 20% of the expected increase, an amount that can be covered by the financial effort of the state in the current context.
The request for reexamination of the ordinance will be debated and voted on by the Chamber of Deputies, as a decision-making body.
