The Bucharest Court of Appeal definitively decided the demolition of an illegally built block in a green space in the Capital, following the admission of an action filed by an association of owners of Şoseaua Giurgiului – Sectorul 4 and the Eco Civica Foundation.
The Bucharest Court of Appeal rejected the appeal declared by the company that built the respective building, upholding the demolition decision adopted in July 2019 by the Bucharest Court, according to Agerpres.
According to the court’s decision, the block must be demolished and the land must be restored to its original state of green space.
“It obliges the defendant SC Codrea Company Imob SRL to bring the land located in Sos. Giurgiului no. 164, sector 4, Bucharest, for which the building permit no. 20-G / 11.02.2016, in the state prior to the start of construction works. (…) It obliges each of the defendants Codrea Company Imob SRL, the City Council of Sector 5 Bucharest and the Mayor of Sector 5 Bucharest to pay the plaintiff to the Association of Owners of Block 5 the amount of 999 lei as court costs of the total amount of 2,997 lei representing the stamp duty and attorney fees related to the first procedural cycle. Clarifies the operative part of civil judgment no. 2,984 / 04/19/2019 in the sense that the address of the property-land with respect to which it was ordered to bring it to the state before the start of construction works is Intrarea Giurgiului no. 8A, sector 4, Bucharest (ex. Giurgiului no. 164, Sector 5), land that, within the Building Permit no. 20-G of 02.11.2016, appears with the address str. Intrarea Giurgiului no. 8A, sector 5, Bucharest “, was reflected in the court’s decision, which was finalized by the decision of the Bucharest Court of Appeal.
According to the Eco Cívica Foundation, it is a second block built by the company in question on land located in Şos. Giurgiului no. 164.
Approximately one hectare of green space located between the blocks of Giurgiului Road no. 164 was returned in 2001 by the Bucharest prefecture, and the new owner divided the land into several lots, which he sold to real estate investors. They started building new blocks in the green space between the old blocks.
The residents of the old apartment blocks sued the company building the new apartment blocks, claiming that the new buildings were being built in green spaces and too close to their homes.
People also complained that the Sector 5 City Council illegally granted a building permit for new buildings, because the land is tabulated in Sector 4.
