A court in Iași County, more precisely the Hârlău Court, decided to force a man from the city to pay the amount of 4,000 lei, to a close relative, after he wrote false information about it.

Specifically, the man accused his sister of not caring for her mother, who died of a serious illness. The judge valued that the man insulted his sister on the social network Facebook, and consequently he is guilty of violating the right to free expression. In addition, the same man also wrote false and defamatory things about another brother, also on Facebook.

According to the judgment of the Superior Court of Cassation and Justice, Facebook is assimilated like any public space, where if a person files accusations against other people, without proving them, they can be sentenced to payment of damages.

What the brother wrote about the sister.

According to the Hârlău court, quoted by the Iași press, the person who was sentenced to pay the four thousand lei wrote about his sister that: “this is one of my mother’s murderers, his name is MS This is one of the greatest libertines that have ever existed ”, after sharing the photo of the woman.

The woman considered herself offended and decided to teach her brother a lesson, so she decided to sue him and demand moral damages, for the insults he brings on Facebook.

‘The court is aware of the importance of freedom of expression in a democratic society and of the right to an image of the people to whom these communications refer, considering that, by publishing a public message with offensive and unproven assessments to the plaintiff , it was negatively his image.

Thus, although the defendant is not satisfied with the fact that the plaintiff did not help her mother during her life, that she did not contribute in any way to her support, that she took things from her home, that several years ago, she had not called to wish him birthday, or that he had taken the part of the hospital unit that the plaintiff had accused of the death of his mother, it does not appear anywhere that his attitude would have caused the death of the mother of the parties or, in addition, that she herself, together with other people (not named by the plaintiff) would have killed her ”, specified the Hârlău judges.

The condemned man also accused his brother, about whom he also wrote on Facebook that he is a “bloodless criminal” and, in addition to the Facebook posts, allegedly posted posters on the victim’s fence.
