DNA asks President Klaus Iohannis to approve the criminal investigation of a former Orban government minister who allegedly received a bribe of 22 tons of tin products. The minister allegedly claimed the bribe for the free allocation to the factory of greenhouse gas emission certificates and for the favorable follow-up of the measures taken by this company to close a non-compliant landfill, the responsibility of the Ministry of the Environment. During the period mentioned by the prosecutors, the Minister of the Environment was Costel Alexe, current President of the Iași City Council.

“In accordance with the legal and constitutional provisions, the chief prosecutor of the National Anti-Corruption Directorate sent the case report to the P.Î.CCJ attorney general, in order to notify the President of Romania to make the request of criminal prosecution against a person, former member of the Romanian Parliament, at the date of the events holding the position of minister, for committing the crimes of:
– bribery,
– instigation of embezzlement.
The request of the National Anticorruption Directorate regarding the criminal investigation against the respective person takes into account that, at this time, there are aspects from which reasonable suspicion arises outlining the following state of affairs:
Between March and April 2020, the person allegedly claimed, directly from the manager of a steel plant, various sheet metal products in connection with the performance of his duties related to the free allocation of allowances to that factory. greenhouse gas emissions and control the measures taken by this company to close a non-compliant landfill.
The respective benefits, in the amount of 22 tons (approx. 103,000 lei), would have been received on April 23, 2020 and July 7, 2020, at the work point of a company run by a relative of his.
The report submitted by the prosecutors of the National Anticorruption Directorate was attached to the submitted request, as well as the volumes (10) containing copies of the criminal investigation file.
This criminal investigation request is framed within the incidence of art. 305 para. 4 of the CPC At present, the person against whom the notification of the President of Romania was requested for the formulation of the request to carry out the criminal investigation benefits from the presumption of innocence.
