The two detainees, Andrei Popiţanu (31 years old), from Suceava, and Bogdan Ianoş Benchea (28 years old), from Bacău, triumphed in prison for serving sentences for particularly serious acts (murder, robbery, moral outrage). to gather new convictions for dozens of crimes behind bars.
No fewer than 15 convictions have been received since they were incarcerated, most of them for “Accident” fraud. Dozens of Romanians across the country fell into the trap of the two criminals and their accomplices, with damages of the order of tens of thousands of euros and lei.
In addition to the files on the events committed behind bars, the two detainees filed dozens of enforcement actions against many courts in the country. Most of the time, when they arrive at the courtrooms, they do not take their steps, stating that they did not formulate the appeals.
The movement of the detainees from one court to another, at the expense of the State, was followed, on several occasions, by unconditional skidding, escalating with major scandals even in the courtrooms. The worst happened in the Bacău Court, where Popiţanu, Benchea and two other detainees beat another detainee, claiming that he had dumped them, right in the defendants’ box.
Also in Bacău, but in the Court of Appeal, the incident occurred whereby the judges again ordered the conviction of Popiţanu and Benchea, both found guilty of violating the solemnity of the sentence and outrage.
The two detainees were in the dock, and at one point, during the hearing, during the trial in which he was a party, dissatisfied with the development of the investigation in the case, he began to address with obscene words and expressions of insult to the court and the prosecutors who had investigated the case.

Specifically, the defendant, after being informed of his procedural rights as a defendant in the case, when intervening, used several insulting expressions to the prosecutors who had investigated that criminal case, namely: the file on that idiot of the prosecutor’s office who made the case … how can I not speak badly … that idiot is … he’s stupid », he continues speaking above the judge, ordering his expulsion from the courtroom, who continued to speak in a high and aggressive tone challenging the president in plenary session. As the penitentiary organizations removed him from the room, he addressed the president in full with the following expression: “I put the pâ on my mother’s neck”, is mentioned in the decision of the Bacău Court.
Immediately after the incident, until the return to the courtroom of the two prison officers who removed Popiţanu from the courtroom, the full president drew the attention of the other detainees in the detainee box to their behavior, asking them not to have fun . At that moment, the detained inmate Benchea, disturbed by the judge’s request, began to address the president in plenary session, in an aggressive and loud tone, various offensive and vulgar expressions, respectively: “put my p … a in their deaths”, “I would put myself in the family and you would kill me in death”, “I would put myself in the death of the judge”.
Immediately, the president of the panel ordered the eviction of Benchea and the detainee from the courtroom, but he objected, pushing the prison officers, “manifesting in an extremely violent manner in gestures, trying to approach the members of the panel of judges” .
After being evacuated from the courtroom of the Bacău Court of Appeal, as a result of the violent behavior manifested, on the way to the room for the temporary accommodation of persons deprived of liberty, within the court, the detainee Benchea, who objected to His movement in that room attacked one of the Iasi Penitentiary agents, who ensured the escort of the detainees. He bit the officer with a finger from his left hand, causing injuries that required 7-9 days of medical attention to heal. After being brought into the room, he made threats of death and physical assault to the other members of the escort team.
Minimal punishment
Sent to court, the two detainees admitted their deeds, being tried by the simplified procedure. Despite the criminal perseverance shown by the two detainees during the execution of the sentences, the Bacău District Court applied the sentences to the minimum provided by law.
Thus, the penalty of one month was applied for violating the solemnity of the judicial hearing (offense for which the penalty limits are between one month and three months or a fine), respectively six months for outrage (the act directed against the agent who suffered injuries) and three months in prison for abuses – facts directed against the other agents of the prison guard – (The crime of abuses is punishable by imprisonment from three months to four years). After the merger of the sentences, the judges established a sentence of 9 months and 10 days in prison for each one. The judgment of the Bacău Court is not final.
Popiţanu is currently serving a 27-year prison sentence and Benchea 15 years.
