The Mayor General of the Capital, Nicusor Dan, declared that the administrative dissolution of the municipal companies of the Bucharest City Council is faster than a judicial liquidation, a process that could extend for several years, reports Agerpres.
At the beginning of the meeting of the General Council of the Capital, Nicusor Dan reaffirmed the will of the representatives of USR PLUS and PNL to dissolve the vast majority of municipal companies.
However, the Mayor General has stressed that this action “cannot be done instantly”, since the administrative acts of incorporation of the companies, although annulled by the court, were followed by other administrative acts that only the court can annul .
And the council, if you want – since they have entered the civil circuit – the General Council can no longer revoke them at this time, even if it is the issuer. On the other hand, there are many contracts with third parties that can only be revoked, canceled, with the consent of those third parties and of course not all third parties that have a supply contract for City Council companies undertake to terminate said contracts. Then we would have a legal path that would take us years and we have an administrative path, manifested by the will of the majority general councilors, to administratively dissolve these companies ”, said Nicuşor Dan.
He recalled that in the previous CGMB meeting, a special monitoring commission for municipal companies was formed and general meetings were appointed for the vast majority of municipal companies.
“The members of the general boards will appoint the boards of directors and then the managers of these companies. Where there are services – either delegated or contracted with municipal structures – we will replace them with structures, with contracts awarded through market tenders. free and when these companies no longer have public services and will be replaced from the public services market provided by individuals, at that moment we will be able to abolish municipal companies, as we promised. It is a much faster process than if we went to court and requested their liquidation in the courts ”, mentioned the mayor general.
