As of January 11, the “Central Electronic Registry of Payment Accounts and Bank Accounts” will come into operation, in which the information of all the bank accounts of companies and individuals will be entered. It will be operated by the National Tax Administration Agency (ANAF), according to GEO no. 111/2020.
According to a press release, banking institutions will have ten days to send all information about the accounts to the Tax Agency to be registered in the registry. The institutions that must provide, for the registration, information on payment accounts and bank accounts are credit institutions, payment institutions and electronic money institutions.
Basically, the registry will contain information on the bank / payment details of all companies and individuals, in order to facilitate the application of the money laundering legislation. Not by GEO. 111/2020, it was established that the information of the bank accounts will be kept in the registry until the moment they are closed ten years later.
What information will be provided
According to the ANAF press release, the following information will appear in the bank account registry:
the identifying data of the account and the client holder;
the identification data of the people who have the right to sign the accounts opened or intend to act on behalf of the client
the identification data of the beneficial owner of the client account;
identification data of the dealer of the safe.
Who will have access to the information
Local tax authorities can also access the information in the registry, but also other public authorities, especially those with competence in the field of prevention of money laundering and criminal prosecution.
The ANAF regulations also stipulate that the central and local public authorities will have access to the registry information based on protocols concluded, upon request, with ANAF, while the criminal investigation bodies and the National Office for Prevention and Fight against Money Laundering will have automatic access. .
The request and transmission of registration information will be made exclusively in electronic format.
