The Senate adopted as a decision-making body the legislative proposal of the Social Democrat Liviu Brăiloiu, by which the head of the Romanian Police General Inspectorate (IGPR) is appointed by the Minister of the Interior and not by the Prime Minister, as stipulated now the law. Then, the Statute of the police officer was amended so that, upon request, the retirement age of police officers can be increased to 60 years.
The Chamber of Deputies rejected legislative proposal on November 27, 2019, but the Senate adopted it on Tuesday, with 91 votes “in favor” and 43 “against”. According to current law, “The Romanian Police General Inspectorate is headed by an inspector general, with the rank of Secretary of State, appointed by decision of the Prime Minister, on the proposal of the Minister of the Interior, after consulting the National Police Corps “, and modifying Art. 8 of the Senate, the normative act stipulates that the IGPR is headed by an inspector general, “appointed by the Minister of the Interior”. In the explanatory memorandum of the legislative project, Liviu Brăiloiu succinctly says that this change is necessary to “streamline the operational management of the Romanian police.”
Covering the staff gap
By the vote they gave on Tuesday, the senators also approved the optional increase in the retirement age for police officers. “Regarding staffing needs, police officers (…) remain on duty, after to reach the standard retirement age, up to 60 years, upon request, as follows: with the approval of the Minister of the Interior, for police officers, with the approval of the inspectors general, for the police agencies ”, is shown in the bill approved by the Senate.
“Given the great shortage of personnel among police officers, the initiative aims, by applying non-discriminatory treatment before the law, (…) creating the possibility that they remain active. The legislative proposal has a positive budgetary impact , considering that for the retired police officer, the Romanian state must bear, in addition to his pension, the salary rights of a new employee “, Liviu Brăiloiu motivated his legislative change.
Opinions divided
Dumitru Coarnă, leader of the National Union of Police and Contract Personnel in Romania, says the measure by which the appointment of the Romanian police chief belongs to the Minister of the Interior is positive. “It is normal for a minister to be able to change a subordinate. It is a return to normalcy after, when he was prime minister, Victor Ponta decided that the appointment of the Romanian police chief should come back to him,” said the union leader.
“The appointment of the Romanian police chief remains political, this legislative change does not bring much,” said the president of the EUROPOL European Police Union, Cosmin Andreica.
Dedicated law, useless to the police.
Regarding the increase in the retirement limit for police officers, the two Romanian police unionists have similar views. “It is a law made with dedication, which comes to the aid of some bosses who refuse to retire. These are people who do little in the system anyway. However, the law is not directed at the police officer who worked in the Not even specialists in the system Those who have worked directly on the street cannot wait to leave when the minimum retirement age is reached, which is around 41.5 years, because stress at work is very high and they feel that they cannot physically anymore. At most 10 percent of police officers actually working in the operating environment were “kicked out of the computer” as we say, that is, they retired at the maximum age of 55 Years later, Romanian police specialists also leave the system because they are “hunted” by civilian commercial entities. Therefore, only the “hooks” we are talking about remain in the system, who do not want to withdraw, “his Cosmin Andreica bellowed.

President of the EUROPOL union
Dumitru Coarnă also comes with a clarification on the increase with dedication to the retirement age of police officers. “The legislative change is being made for Chief Commissioner Constantin Dancu. Liviu Brăiloiu, a Senator from Constance, wants to extend his stay in the system to the respective Commissioner who is now empowered to head the Constanta County Police Inspectorate and who has reached the retirement threshold. Therefore, on paper, the initiative seems positive, a police officer may choose to increase the retirement age if he is healthy and if the institution wants it, but, I repeat, he is dedicated, there may be other beneficiaries in the system, “said Dumitru Coarnă.
