The exercise of the powers of the Ministry of Foreign Affairs is related to the application of work contracts already concluded by Romanians who are going to work abroad, Foreign Minister Bogdan Aurescu said Monday at the hearing of the Senate committees of European affairs, foreign policy and work, family and social protection.
The topic of the hearing is how the AMF and the Ministry of Labor and Social Protection managed the movement of Romanian workers abroad in the context of the SARS-CoV-2 pandemic.
The Minister of Foreign Affairs declared, in this context, that “it is very important that the contractual clauses are drafted and concluded in advance with respect to the interests and rights of Romanian workers”.
He submitted such a contract concluded by a Romanian seasonal worker in Germany, a contract consulted by a representative of the AMF.

“This contract is concluded in Romanian and German, so that the worker has knowledge in Romanian about its content. The relevant German legislation applies. There are detailed provisions on working conditions. For example, there is talk of remuneration of 9.35 According to the information we have, it seems that, regardless of how much work, the temporary worker is guaranteed the minimum wage in the economy in Germany. The minimum wage in the economy in Germany, according to my information, is 1,621. but, in practice, the average income of a temporary worker who works for a period of approximately 70 days (…) can reach up to 8,000 euros net, and on average it is 4,500 euros net, “Aurescu pointed out.
According to the Foreign Minister, “an agreement was not reached between Romania and Germany to allow Romanian seasonal workers to go to Germany to work, for the simple reason that such an agreement is not needed, this possibility arises from legislation that provides for freedom of movement for work. “
He added that since the beginning of the COVID-19 crisis, the Ministry of Foreign Affairs has informed Romanian citizens about their rights.
At the same time, the MFA filed a complaint in several cases related to Romanians working abroad, added Bogdan Aurescu.
“We act even when there are no such specific applications and we notify each other proactively, taking measures at the level of the central local authorities, to verify how the provisions of employment contracts are verified, how the provisions of European and national legislation are applied pertinent. We have files for each case, the steps taken and the results of these steps, “explained the minister.
He mentioned 14 recent cases, 13 in Germany and one in the Netherlands. In Germany, Aurescu said, of the 13 cases, eight were self-reported.
“In most cases, the Romanian embassies in Berlin and The Hague, respectively the Romanian consulates general in Bonn, Stuttgart and Munich, complained to each other as a result of the information reported in the media, took urgent action with the federal authorities and verify if the accused are confirmed and request, as the case may be, that the local authorities be notified (…), “said the Minister of Foreign Affairs.
Bogdan Aurescu stated that in all such situations “he reacted extremely quickly and absolutely all levers were used locally”
